Many on the left celebrated last year after Special Counsel Jack Smith indicted former President Donald Trump for mishandling classified documents.
Yet while Democrats may have hoped Smith would saddle Trump with a guilty verdict, some now charge that he is failing to deliver.
Documents trial indefinitely postponed
Among them is Slate contributor Shirin Ali, who lamented in an article published on Monday that there “won’t be another Trump trial before the election.”
Ali recalled how the former president “earned a major victory” last week when Judge Aileen Cannon indefinitely postponed the start of Trump’s trial, which had been scheduled to begin on May 20.
In her decision, Cannon pointed to the number of “substantive pretrial motions” which have yet to be resolved, including one in which Trump’s defense team is seeking access to hundreds of documents.
The judge thus concluded that setting a trial date “would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions before the Court.”

What’s more, Trump’s lawyers are now asking for the case to be dismissed, citing a recent admission by Smith that some evidence taken during a raid on the former president’s home was mishandled.
“Smith has not publicly commented on Cannon’s decision, and it’s not clear what options he has to potentially appeal it,” Ali wrote.
“But it’s looking pretty certain that Trump won’t face a jury trial before the November election over charges of mishandling classified documents in the waning days of his first presidency,” she stressed.
Ali also acknowledged that Trump’s Georgia Racketeer Influenced and Corrupt Organizations (RICO) Act case has hit major snags as well.
The Georgia Court of Appeals has announced that it will grant an appeal to Trump’s attorneys, who are seeking to have Fulton County District Attorney Fani Willis disqualified.

Meanwhile, Ali admitted that testimony by adult film star Stormy Daniels in Trump’s New York criminal case “got to be a bit much for New York Supreme Court Justice Juan Merchan.”
She observed that Merchan at one point “directed prosecutors to limit Daniels’ answers” given their increasingly graphic nature.
Interestingly, none of Trump’s legal problems appear to be hurting him with voters, as a New York Times/Siena poll shows him leading President Joe Biden in five of six swing states.
