Hunter Biden was denied his motion to dismiss his three felony gun charges by a judge, as an appeals court also ruled against him on Thursday, as Judge Maryellen Noreika of the U.S. District Court for the District of Delaware scheduled a trial to last between three and six days, starting on June 3.
The Court of Appeals for the Third Circuit dismissed his appeal, wherein Hunter cited precedents concerning “former government officials claiming immunity from prosecution based on separation-of-powers principles.” However, Hunter is not a former government official.
Meanwhile, Democrats are actively pursuing the prosecution of former President Donald Trump, who is a former government official, in state courts, The Daily Wire noted.
Hunter also attempted to have the charges dismissed by arguing that the government was committed to a “diversion agreement,” which would have eventually led to the dismissal of the gun charges.
U.S. Attorney David Weiss initially drafted the agreement but withdrew it last summer following embarrassment when whistleblowers presented evidence suggesting that the DOJ was impeding investigators on the case. Prosecutors were unable to cite any precedent where they had agreed to such a lenient “diversion agreement” for felony gun charges for any other individual. Additionally, a probation officer refused to approve the deal, the outlet reported.
A lawyer for rapper Kodak Black, who was handed a three-year prison sentence for similar charges, said, “There’s no such thing as not getting jail time on a gun charge… 2 tiers of justice?”
Still, Hunter argued to the court that he was a victim of “selective and vindictive prosecution” and continued demanding documents to prove it even after the judge in the case ended the argument. The first son also went so far as to demand information about grand jurors, which is normally secret, because “it remains possible that in this highly-politicized matter, the grand jury was selected without regard to the bias that people might have.”
“There will be no such evidentiary hearing,” the judge wrote.
