The federal appeals court has declined to dismiss the indictment against Hunter Biden for federal gun charges, as per official records. As per the court document made public on Thursday, the United States Court of Appeals for the Third Circuit rejected Hunter Biden’s appeal.
Hunter Biden, the son of Democratic President Joe Biden, is scheduled to face trial in Delaware next month. With the court’s decision, the trial will proceed as planned. The official court document released on Thursday reads:
“The defendant in this criminal case appealed three pretrial orders entered on April 12, 2024, denying his motions to dismiss the indictment. This appeal is DISMISSED because the defendant has not shown the District Court’s orders are appealable before final judgment.”
Earlier this year, Biden’s legal team submitted a motion to the federal court. They are asserting that the diversion agreement, which had been previously agreed upon by the Department of Justice (DOJ) and Biden’s legal team, should continue to be in effect. Last year, Biden was charged with three felony counts for purchasing a revolver in 2018 while actively using narcotics.
Despite these charges, Hunter Biden has pleaded not guilty to all of them. He has openly acknowledged his struggles with substance abuse during that period, specifically with crack cocaine. Nevertheless, his lawyers maintain that he did not violate any laws. Furthermore, they argue that if it were any other nonviolent, first-time offender, they would not have faced charges. Unfortunately, a plea deal that could have resolved the case without a trial fell apart in July 2023. As reported at the time, the judge who was supposed to approve the favorable agreement instead raised additional concerns.
Biden’s legal team has subsequently moved to dismiss the case by contending that the prosecutors succumbed to political influence. They allege that the deal was criticized by Republicans, including President Donald Trump, as a “favorable agreement.” Furthermore, Biden’s lawyers have asserted that the immunity provisions from the original agreement remain valid. Attorney Abbe Lowell, representing Biden, urged Judge Maryellen Noreika to issue a final decision on the issue.
A jury trial lasting three to six days is scheduled to commence on June 3 under Noreika’s supervision. A pre-trial meeting is planned for May 24. Additionally, Biden is anticipated to face trial on June 20 in Los Angeles for federal tax charges stemming from the same investigation led by Special Counsel David Weiss.
