Joe Biden’s hitman, Jack Smith, is probably crying himself to sleep recently after receiving a series of blows from President Donald Trump.
Judge Aileen Cannon decides to postpone indefinitely the sham classified documents trial against Trump. This move reduces the chance of any trial before the general elections in November.
The prosecution and defense agreed to move the May 20 hearing to allow pre-trial hearings on critical CIPA issues and motions.
US District Judge Aileen Cannon noted on Tuesday that there will be no trial on May 20; however, she did not announce a rescheduled date. Cannon’s pre-trial hearings will last until July 22.
The presiding judge noted that given the outstanding issues on Smith’s case against President Trump, it would be “imprudent” to set a new trial date.
“The Court also determines that finalization of a trial date at this juncture — before resolution of the myriad and interconnected pre-trial and CIPA issues remaining and forthcoming — would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions before the Court, critical CIPA issues, and additional pretrial and trial preparations necessary to present this case to a jury. The Court therefore vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants’ right to due process and the public’s interest in the fair and efficient administration of justice,” Cannon wrote in a five-page filing.
This decision was a major win for Trump, while this does not paint a good picture for Smith, who is still on standby for the Supreme Court decision on Trump’s appeal for presidential immunity.
Meanwhile, Cannon stressed that she intends to resolve related issues on the case first before setting a new trial date. She assessed that all the pre-trials will last until late July.
The judge also scheduled a hearing on key motions, including a recent appeal from Walt Nauta, Trump’s co-defendant, to dismiss Smith’s case for selective and vindictive prosecution.
On June 21, the court will discuss the motion of Trump to dismiss the lawsuit based on the unlawful appointment and funding of Special Counsel Jack Smith.
Smith last Friday alleged that the FBI disorganized the documents on the boxes and admitted that he is now uncertain if the files were properly returned.
In April, key evidence exposed that the Biden administration orchestrated the hoax classified document charges against the former president, as Judge Cannon ordered heavily redacted documents to be unredacted and released publicly.
