Special Counsel Jack Smith woke up this week to a rather rude greeting by Rep. Elise Stefanik (R-N.Y.).
Donald Trump had asked for Republicans’ help in ending these cases against him, and Stefanik answered the bell.
She filed an ethics complaint against Smith this week, charging him with election interference.
Taking Smith Down
Stefanik’s complaint sounded more like a Trump stump speech than it did a legal filing.
She more or less regurgitated everything that Trump has been saying about the cases in an effort to get Smith derailed in his pursuit of Trump.
In part, her letter stated, “It’s obvious to any reasonable observer that Jack Smith is trying to interfere with the 2024 election and stop the American people from electing Donald Trump.
“At every turn, he has sought to accelerate his illegal prosecution of President Trump for the clear (if unstated) purpose of trying him before the November election.”
Now, does this filing have a chance of being successful?
That is pretty unlikely because her entire charge relies on the DOJ “rule” that they will not open an investigation within 60 days of an election.
This investigation has been ongoing, however, which was Smith’s office’s response to her filing.
This may, however, slow Smith down even more, all but guaranteeing that his cases will not see the inside of a courtroom before voters head to the polls in November.
If Trump can manage that, he will have effectively killed these cases against him.
I think Republicans would be better served to try to show collusion between the DOJ and the Biden administration to drop these charges to time them out with the election cycle, which is what most of us think happened here.
If they can prove that, they can take down Garland and Biden for weaponizing the DOJ to take out a political opponent, ironically, what they are complaining Trump will do if he wins the election.
