An interesting case was just taken on by the Supreme Court, and I am curious to see the reaction around the country.
The Supreme Court declined to block the new age-verification law in Texas for pornographic websites.
The ruling came in response to an emergency petition by the Free Speech Coalition.
Block It
In Texas, sites featuring pornographic content must verify that the user is 18 years or older before allowing them to access the content on the website.
Now, this seems like a no-brainer to me: to protect young children from accessing content they should never be looking at.
Texas Governor Greg Abbott signed the bill into law last year, and it has been fought against ever since.
Judge Alan Ezra blocked the law in September, claiming that it violated the First Amendment because it “substantially regulates protected speech, is severely underinclusive, and uses overly restrictive enforcement methods.”
That ruling was overturned by the 5th Circuit Court of Appeals, but the panel did uphold the part of the suit that wanted to block warnings for harmful content on the site.
The Free Speech Coalition claimed the law was “ineffective, unconstitutional and dangerous.”
The ACLU also made a statement on the matter, claiming the law would “improperly burden free speech online.”
I am not sure how porn qualifies as “free speech,” as this just seems like a commonsense measure to protect our children.
But then again, the left has proven time and again that the last thing it wants to do is protect young children from harmful content.
