The state of Florida, under Governor Ron DeSantis, has announced it will not adhere to new federal Title IX guidance issued by the Biden administration, which aims to extend protections to students based on their sexual orientation and gender identity.
DeSantis expressed strong opposition to what he perceives as federal overreach into personal and state rights—setting the stage for a potential nullification crisis over the God-given rights of broad-shouldered, hirsute males to use the same locker rooms as cisgender women and girls.
“We will not comply, and we will fight back. We are not going to let Joe Biden try to inject men into women’s activities. We are not going to let Joe Biden undermine the rights of parents and we are not going to let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida,” DeSantis said in a video shared on X, addressing the camera while standing in front of the seal of the Sunshine State.

Echoing the Governor’s stance, Florida Attorney General Ashley Moody criticized the new rules, asserting that they compromise the safety and privacy of women. Moody highlighted specific concerns about the implications for women’s spaces and scholarships.
“Biden’s new Title IX rules shred protections for women — that so many fought for over decades,” Moody said, as reported by Florida Politics. “The idea that young girls can now legally be forced to undress in the same room with males in what is supposed to be a safe space like a locker room, that a young woman could be randomly assigned a roommate that is a biological male with little-to-no-say over the matter, or that biological men would be eligible for women’s scholarships is ludicrous. We absolutely plan to challenge this betrayal of women in court.”
The new updates modify Title IX, a 1972 law that initially aimed to prevent discrimination based on sex in educational settings, to extend its protections to include gay and trans-identified students. This adjustment also mandates accommodations for pregnant students, such as access to private lactation spaces.
The new Title IX rules were announced last week by President Biden’s Secretary of Education Miguel Cardona.
“For more than 50 years, Title IX has promised an equal opportunity to learn and thrive in our nation’s schools free from sex discrimination,” said Cardona in a post on X. “These final regulations build on the legacy of Title IX by clarifying that all our nation’s students can access schools that are safe, welcoming, and respect their rights.”

“For more than 50 years, Title IX has paved the way for tremendous strides in access to education for millions of students across the country. Every student deserves educational opportunity free from discrimination. That is why today the U.S. Department of Education (Department) released its Final Rule under Title IX, which prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. The final regulations promote educational equity and opportunity for students across the country as well as accountability and fairness, while empowering and supporting students and families,” the Education Department said in a statement.
Governor DeSantis has been notably proactive in legislating on issues related to gender identity. On the first day of Pride Month in 2021, he signed SB 1028, which prohibits transgender athletes from competing in women’s sports. In the following year, he endorsed legislation that limits the use of pronouns in schools to those that correspond to a person’s sex at birth.
