It was a foregone conclusion, but Democrats never think about those. Former President Trump was acquitted by the Senate in his 2nd impeachment trial by a vote of 57-43. Seven of those votes were Republicans who stupidly defected to the Democrats’ narrative. But they missed the 67 vote threshold to convict, which means they may try something else to prevent him from running again.
The impeachment of Donald Trump on the charge of incitement was merely a rushed act of partisan retribution. I was against the Senate taking jurisdiction in this trial from the start, as the House had chosen to impeach without providing due process or introducing evidence.
The House brought only one charge before the Senate: incitement. Donald Trump used heated language, but he did not urge anyone to commit acts of violence. The legal standard for incitement is very high and it is clear by the results of this vote that the House Managers failed to present a coherent standard for incitement.
In the United States, politicians from all parties and across the country routinely use words and phrases like ‘fight,’ ‘win,’ and ‘take back our country’ in speeches and interviews, including numerous Senate Democrats and House Impeachment Managers. Using this rhetoric is not impeachable, whether made by Republicans or Democrats.

Saturday morning, the Senate voted to hear more witnesses, which would have drawn out the process. But then the Trump defense and impeachment managers struck a last minute deal to bag the witness issue. As of yesterday, Senators believed today would be the vote, but then impeachment managers changed their mind this morning… then the deal was struck and everything changed again.
Trump defense attorney Michael van der Veen said that if Democrats want more witnesses, he needs to depose House Speaker Nancy Pelosi (D-CA) – not by Zoom but in Philadelphia – and Vice President Kamala Harris. Van der Veen said he would need up to 100 depositions.
The Senate vote enraged many Republicans, such as Sens. Joni Ernst (R-IA) and Ted Cruz (R-TX).
Ernst, the Senate GOP vice chair, called the vote a “total, total shit show.”
She called the approval of additional witnesses a “tool of revenge” against the 45th president.
The Iowa conservative then promised that if Democrats wished to extend the impeachment trial against Trump, they will also drag out the trial. She also promised to block the consideration of potential nominees.
“If they want to drag this out, we’ll drag it out. They won’t get their noms, they won’t get anything,” Ernst said.
“Dems had agreed to know [sic] witnesses, then House Managers changed their mind this morning. Schumer blindsided. Pandemonium. They’re negotiating now to figure out next steps,” Sen. Ted Cruz (R-TX) said in a statement on Saturday.
The deal that led to Trump being acquitted:
Trump defense attorneys and the impeachment managers struck a deal to stop the whole demand for witnesses. Either make a deal or drag this out and maybe not get what they wanted in the nominations. The vote was taken and the Senate is now able to move on to deal with Democrat nominees and a COVID relief package. And Senator Ernst was right- it was a total shit show. Schumer was taken aback at the deal, and Pelosi dodged a very public deposition.
The defense team had shown a video yesterday revealing the real incitment to violence of the Democrats: which led to some uncomfortable looks between Democrat Senators. They had to know that they were about to step into a real pile of it if they continued to drag the process along.
Therefore, the headlines today read “Trump Acquitted” – damn straight.
