Stephen Miller’s America First Legal has accused the Department of Justice’s Office of the Inspector General of being politically biased.
America First Legal accused the DOJ OIG in a Freedom of Information Act (FOIA) request filed on Wednesday.
Seen here, the FOIA demands access to “all records sufficient to show the names and positions of all special agents, auditors, inspectors, program analysts, data analysts, and attorneys, including all political appointees and career civil servants with a grade of GS-14 or its equivalent and above, working in the” office.
The goal of this request is to search for the “existence of politically motivated employees in positions that demand impartiality,” according to a press release from America First Legal.

“The Department’s Office of Inspector General itself describes that ‘[i]n light of today’s wide-spread lack of trust and negative views of government, a key facet of the Department’s challenge of strengthening public trust is ensuring that DOJ personnel fulfill their duties without any actual or perceived political influence or partisan consideration,’” the FOIA request itself reads.
“Despite this unambiguous obligation to avoid the appearance of political or partisan considerations, there is evidence that the Office of the Inspector General is deeply infected with partisan actors,” it continues.
America First Legal believes something is up at the office because of a recent report filed in The Federalist by seasoned investigative journalist Mollie Hemingway. Published earlier this month, the report cited numerous examples of politically motivated appointees in the DOJ OIG.
For example, there’s Christine Monta, who reportedly participated in the office’s investigation into the U.S. Attorney’s Office for the Middle District of Pennsylvania’s inquiry into mail-in ballot mishandling.
“[She] now works for the left-wing MacArthur Justice Center, which brags about its legal efforts against Trump,” Hemingway reported. “She previously was one of the Justice Department’s Civil Rights Division lawyers on the 2015 lawsuit the Obama administration brought to force public schools to allow boys in girls’ bathrooms.”
“She also joined then-Principal Deputy Assistant Attorney General Vanita Gupta in challenging Texas’ voter ID law. Monta made $1,014.50 in political donations in 2019 and 2020, all of which were to Elizabeth Warren’s presidential campaign or ActBlue. Monta clerked for left-wing Judge Stephen Reinhardt,” the reporting continues.
Yet another offender is OIG attorney Deborah Falk Zerwitz, who’s donated 35 times to Democrats or their allies since 2007. Zerwitz is especially active on social media, where she’s repeatedly displayed her leftist bias, according to AF Legal.
“Her alleged X account liked a tweet saying, ‘We need to send Donald Trump packing, but we can’t stop there. We need to boot his Republican enablers out of office — at every level of government,’” AF Legal’s press release notes.
“She has liked tweets expressing ‘hate’ for Kayleigh McEnany and supporting the removal of 15 Republican senators from President Trump’s impeachment jury. Zerwitz liked another tweet that stated that Mitch McConnell was ‘eroding our democracy’ and another asking, ‘Why are mythical white grievances prioritized over the well being of black kids?’” the press release continues.

But neither Monta nor Zerwitz are bugs — they’re features, according to AF Legal.
“[T]he fact of the matter is that there are likely others within the OIG with similar backgrounds that the American people have no idea about–politically motivated and biased personnel who seek to use the levers of power to advance their own agenda while simultaneously undermining public confidence in the institution,” he press release notes.
In the FOIA request itself, AF Legal argues that it’s “imperative that Americans learn whether these views persist within the Department of Justice,” especially during an election year.
In a statement, America First Legal executive director Gene Hamilton said that the American people deserve answers about this bias.
“An office that employs individuals with clear political biases, yet holds itself out to the public as being fair, objective, and impartial harms the public trust in government institutions,” he said. “If the ‘watchdog’ is a mere partisan bulldog, it does not deserve to exist. We will obtain and expose the truth to the American people.”
