President Donald Trump scored a major legal victory today as a New York appeals court threw out the half-billion-dollar civil fraud fine, calling it "excessive" under the Eighth Amendment, which bars cruel and unusual punishment. The lawsuit, filed by New York Democrat Attorney General Letitia James before the 2024 election, alleged that Trump misrepresented his assets to secure better business loans. James says she plans to appeal — even as she faces allegations of her own mortgage fraud.
OAN’s Alicia Summers featured attorney David Pivtorak last year, who accurately predicted several Supreme Court cases and correctly forecasted that the civil portion of the case would be overturned. While the massive financial penalty is gone, the court upheld the fraud finding and the temporary ban preventing Trump and his sons from running New York businesses. The case could now advance to New York’s highest court for further review.
