Newly disclosed FBI documents obtained by Just the News reveal that a career Democratic staffer on the House Intelligence Committee repeatedly warned the bureau—beginning in 2017—that then-Rep. Adam Schiff (D-Calif.) had authorized the leaking of classified information in a bid to politically damage President Donald Trump during the now-debunked Russiagate investigation.
According to FBI 302 interview reports turned over to Congress by former House Intelligence Committee Director Kash Patel, the whistleblower, a registered Democrat and longtime colleague of both Schiff and former Republican chairman Devin Nunes, described Schiff’s actions as “unethical,” “illegal,” and “treasonous.” The staffer claimed Schiff justified the leaks by citing the Constitution’s Speech and Debate Clause, suggesting it would shield him from prosecution.
No record of any formal Department of Justice opinion backing that interpretation has been made public.
Meetings Where Leaks Were Allegedly Planned
In a 2023 interview with the FBI’s St. Louis office, the whistleblower said he personally attended an all-staff meeting where Schiff allegedly told aides they would leak classified information “derogatory” to Trump to help secure an indictment against the president. When the whistleblower objected, he was reportedly reassured that “they would not be caught.”
Similar claims were made to FBI agents in Washington as early as 2017, shortly after Trump took office. The memos state that Schiff’s staff targeted then-National Security Adviser Mike Flynn as part of a broader strategy to weaken the administration. Rep. Eric Swalwell (D-Calif.) was also named by the whistleblower as a suspected leaker.
DOJ Declined to Act
Despite multiple interviews with the whistleblower over six years, Justice Department prosecutors declined to pursue charges—citing the same constitutional protection Schiff allegedly invoked. Officials told Just the News that some of the DOJ figures who declined to prosecute remain in powerful positions today.
Kash Patel criticized the decision, saying, “It was all done with one purpose: to weaponize intelligence and law enforcement for political gain. Those abuses eroded public trust in our institutions.”
Political Ambitions and the Clinton Connection
The whistleblower told the FBI that Schiff expected to be appointed CIA director if Hillary Clinton had won the 2016 election. After Trump’s victory, Schiff allegedly treated the outcome as a “constitutional crisis,” directing staff to use any Intelligence Community contacts to build a public case for a 9/11-style commission into Russian election interference.
By February 2017, classified leaks had become a tool to “topple the administration,” the staffer claimed. One “particularly sensitive” document allegedly viewed by Schiff and Swalwell in mid-2017 appeared in the media almost verbatim within 24 hours.
Pattern of Collusion Claims and False Narratives
Schiff played a central role in promoting the Steele dossier and the Trump–Russia collusion theory, even reading its discredited claims into the congressional record in March 2017. He continued to assert “ample evidence of collusion” through 2019, despite the Mueller report finding no criminal conspiracy.
DOJ Inspector General Michael Horowitz later found significant misconduct in the FBI’s handling of FISA warrants related to the investigation, including reliance on the discredited Steele dossier, which was funded by the Clinton campaign.
Censure and Presidential Pardon
In 2023, the House formally censured Schiff for “spreading false accusations” and perpetuating unverified claims from the Steele dossier. Earlier this year, President Joe Biden issued a pardon to Schiff for actions connected to his service on the January 6th Committee, a move Schiff publicly criticized as “unnecessary” but politically understandable.
Why It Matters
The FBI memos underscore a longstanding concern that partisan actors weaponized intelligence for political ends—and that institutional safeguards failed to stop it. The revelations also raise fresh questions about the DOJ’s reluctance to prosecute high-profile figures, even amid detailed whistleblower allegations.
With Congress now in possession of these documents, lawmakers may seek to investigate not just Schiff’s alleged conduct, but the DOJ officials who shielded him from scrutiny.
