Newly released documents reveal that more than 65,000 instances of concern regarding unaccompanied migrant children were flagged by government employees and contractors under the Biden administration—and then ignored.
The reports were collected from 2021 to 2024 by personnel responsible for the care of children who crossed the U.S.–Mexico border without a parent. According to internal Department of Health and Human Services (HHS) records obtained by Senate Judiciary Chairman Chuck Grassley (R-IA), the Trump administration identified the backlog but the Biden administration failed to investigate the cases.
Instead, HHS prioritized rapid placement of children with adult sponsors, even as signs of potential abuse, trafficking, and fraud piled up.
“Not a single child should continue to suffer because of the previous administration’s failures,” Grassley stated in a letter to Trump’s HHS Secretary Robert F. Kennedy Jr., urging a full review of the neglected files.
Of the 65,000 total cases, at least 56,591 were flagged as serious concerns, including 7,346 related to human trafficking and 1,688 suspected cases of fraudulent sponsorship—adults pretending to be family members.
Few Investigations, Fewer Convictions
Despite the staggering volume of red flags, only 528 cases were referred to federal law enforcement. Of those:

36 were accepted for prosecution

11 people were arrested

Only 3 were convicted
Meanwhile, over 500,000 children crossed the border unaccompanied under the Biden administration—more than under any prior administration.
Border Patrol agents initially detain these minors and transfer them to HHS, which is then tasked with placing them with sponsors in the U.S. However, the agency appears to have failed at basic vetting, according to internal contractor records and whistleblower accounts reviewed by Grassley’s office.
“[W]histleblowers have confirmed the issues… were present at other HHS facilities,” Grassley noted, suggesting this is a system-wide failure that endangered thousands of children.
Whistleblowers Silenced, Oversight Stonewalled
Grassley accuses Secretary Xavier Becerra’s HHS of obstructing investigations and blocking whistleblowers from cooperating with congressional oversight.
“HHS under Secretary Becerra instructed contractors and grantees not to answer,” Grassley wrote, “instead sending my inquiry to the Assistant Secretary for Legislation, who of course also failed to provide any requested information.”
The senator says two-thirds of the subpoenas he issued to HHS were ignored.
Trump Administration Launches Cleanup Operation
In contrast, the Trump administration began a multi-agency effort in February to review the backlog and pursue potential criminal investigations.
Grassley is now pressing for regular updates on case resolutions, as well as any new developments related to human trafficking networks that may have targeted vulnerable minors in custody.
This crisis marks yet another point of controversy in the ongoing debate over U.S. immigration policy, as critics charge that speed and optics took precedence over the welfare of children in federal custody.
