Newly released police body camera footage shows Sen. Nicole Mitchell (D-MN) being arrested inside her stepmother’s home after officers responded to reports of a break-in on April 22, 2024.
The video captures officers walking through the house with their weapons drawn before confronting Mitchell, who was found inside the property without permission.
Sen. Mitchell, 49, currently represents District 47 in the Minnesota Senate.
She was elected to office in 2022.
She is now facing felony charges of first-degree burglary, which carry a maximum sentence of up to 20 years in prison under Minnesota law.
An additional charge related to the possession of burglary tools could add up to three more years if the jury finds she intended to use a crowbar found at the scene.
In the one-minute bodycam clip released by authorities and played in court, an officer orders Mitchell to lie on the floor.
She complies and attempts to explain her presence.
“I was just trying to get a few of my dad’s things because he wouldn’t talk to me anymore,” Mitchell says as she is being handcuffed.
While she is led out of the house to a police cruiser, Mitchell adds, “No one stole anything here!”
Mitchell later told officers she was checking on her stepmother, Carol Mitchell, who she claimed suffers from Alzheimer’s disease.
She had not been able to reach her stepmother for several weeks and was concerned for her safety, according to Sen. Mitchell.
In the video, she offers Deputy Sheriff Ethan Wothe a series of text messages which she claims show evidence of Carol’s delusions and cognitive decline.
Deputy Wothe looks through the messages but tells Mitchell, “It’s not a reason to break into anybody’s house.”
During the interaction, he also mentions to another officer on the scene, “I don’t know if it means anything but she’s a state senator.”
The case is now being heard in court.
During the trial, Carol Mitchell took the stand and delivered key testimony as the homeowner and complainant in the case. However, the Minnesota Reformer reported that her memory proved inconsistent under questioning by Becker County Attorney Brian McDonald.
When asked what year she met her late husband, Roderick Mitchell, Carol replied, “I’m bad at that.”
The court took a recess, and Carol later remembered that Roderick died in 2023.
Carol Mitchell also made conflicting statements about the events of the night of April 22.
Her recollection of where Senator Mitchell was found inside the house differed from the police report.
She also alleged that her stepdaughter had harmful intentions.
According to police accounts presented in court, Carol Mitchell told responding officers at the scene, “She wants to take me out,” and accused her stepdaughter of financial motives, stating, “She’s trying to get my money.”
After Sen. Mitchell identified herself to police that night, her stepmother reportedly said, “You had your aunts do it,” a phrase that has not yet been clarified in court testimony but appears to suggest an ongoing family dispute over property or inheritance.
Prosecutors allege that Sen. Mitchell unlawfully entered the home with the intent to retrieve property and potentially obtain access to sensitive legal documents.
Carol Mitchell told officers she believed her stepdaughter was searching for a “tin box” that contained legal papers related to her late father, Roderick Mitchell.
The crowbar discovered at the scene was submitted as evidence and may be considered a burglary tool if the jury determines it was brought with intent to gain unlawful entry.
Mitchell has not denied being in possession of the tool but has not yet addressed its use or purpose.
The jury seated for this trial includes 10 men and four women from Becker County.
The region voted decisively for Donald Trump in the 2020 presidential election, giving him a 33-point lead over Joe Biden.
While juror political affiliation is not disclosed, the location’s voting history has been noted in local media coverage of the case.
No official statement has been released by the Minnesota Senate regarding Mitchell’s arrest or the ongoing trial.
She remains in office while the case proceeds.
It is not yet clear whether any disciplinary measures will be taken against her by the state legislature.
