A federal judge on Thursday halted the implementation of President Donald Trump’s executive order aimed at ending birthright citizenship just weeks after the U.S. Supreme Court narrowed the power of lower courts to block federal policies.
Axios reports U.S. District Judge Joseph Laplante granted a preliminary injunction in response to a class-action lawsuit filed by immigrant rights advocates, including the American Civil Liberties Union. The judge certified a nationwide class of “all current and future children who are or will be denied” citizenship under Trump’s directive, which targeted children born in the U.S. to undocumented immigrants.
Although the Supreme Court’s recent 6–3 decision limited the scope of injunctions issued by federal courts, it left an opening for broader relief through class-action lawsuits. Advocates quickly seized the opportunity to challenge the executive order, which they argue would deny constitutional protections to children born on U.S. soil.
In court, Judge Laplante, a George W. Bush appointee, described the case as “not a close call to the court,” according to CNN. He emphasized that the abrupt policy shift and the resulting “deprivation of U.S. citizenship” would inflict “irreparable harm” on affected families.
Laplante temporarily stayed the injunction for seven days to allow the government time to file an appeal. The legal challenge centers on the 14th Amendment, which guarantees citizenship to “all persons born or naturalized in the United States.” Trump’s order, issued earlier this year, claimed that the children of undocumented immigrants are not subject to U.S. jurisdiction and therefore not entitled to citizenship.
In their filing, attorneys for the plaintiffs warned that if the order were allowed to remain in effect, “those children will face numerous obstacles to life in the United States.” The injunction now provides a temporary safeguard while the case continues to wind its way through the courts.
