Once again, a Democrat-appointed judge is blocking yet another Trump executive order.
Trump’s order to halt asylum claims will be sidelined until further notice. This is a quest for Trump that dates back to his first administration.
Round 1
As soon as Donald Trump took office in 2017, he issued a border security executive order that would have halted asylum seekers.
The administration then put in place new rules that would have raised the threshold for asylum seekers.
In July 2017, the administration ended a program called Family Case Management, which blocked families from staying in the country while their cases were being processed.
While still in office, then-Attorney General Jeff Sessions announced the zero-tolerance policy, among others, that were crushing blows to illegal immigration advocates.
Round 2
Those were just a few of the measures that Trump took, but you get the idea. Unfortunately, when Joe Biden took office, his administration started to dismantle all of this.
That led to a second executive order by Trump on his first day in office of his second term, called the “REALIGNING THE UNITED STATES REFUGEE ADMISSIONS PROGRAM.”
The order, in part, stated, “The United States lacks the ability to absorb large numbers of migrants, and in particular, refugees, into its communities in a manner that does not compromise the availability of resources for Americans, that protects their safety and security, and that ensures the appropriate assimilation of refugees. This order suspends the USRAP until such time as the further entry into the United States of refugees aligns with the interests of the United States.”
Needless to say, the order was challenged.
Halted
U.S. District Judge Randolph Daniel Moss, an Obama appointee, is about to test the Supreme Court ruling on injunctions, as he just halted Trump’s order. Moss ruled that Trump “lacks the inherent constitutional authority” regarding the measures taken in this executive order. The order has now been stayed for two weeks to allow the administration time to respond to his ruling.
ACLU attorney Lee Gelernt responded to the ruling, “Not only will it save the lives of families fleeing grave danger, it reaffirms that the president cannot ignore the laws Congress has passed and the most basic premise of our country’s separation of powers.”
The Trump administration, as expected, went right after the judge, with top adviser Stephen Miller stating, “To try to circumvent the Supreme Court ruling on nationwide injunctions a marxist judge has declared that all potential FUTURE illegal aliens on foreign soil (eg a large portion of planet earth) are part of a protected global “class” entitled to admission into the United States.”
My stance on immigration is quite clear, so I am looking forward to the administration’s response and likely appeal of the expected verdict. If the president of the United States does not have the authority to pause this program, who does? I firmly agree with Trump on this one that we needed a break for this country to recover from what the Biden administration did. Trump was not ending asylum, merely pausing it, and I would have to think he has that right as president.
