The French National Anti-Terrorism Prosecutor’s Office (PNAT) has opened a judicial investigation for complicity in genocide, incitement to genocide, and complicity in crimes against humanity against Franco-Israelis suspected of participating in actions to block humanitarian aid to Gaza between January and May 2024. It is the first time that the Anti-Terrorism Prosecutor’s Office is taking up a complaint for complicity in genocide in Gaza.
The judicial inquiry began on May 22, 2025, following a promising preliminary indictment. The case was assigned to two judges from the Crimes Against Humanity Division of the Paris judicial court. The complaint was lodged by Marion Lafouge and Damia Taharraoui, two French attorneys representing the Jewish Union for Peace (UFJP), along with a Franco-Palestinian victim, a grandmother who opted not to testify under her real name due to concerns for the safety of her relatives still residing in Gaza. The victim has denounced organisations that participate and encourage actions designed to hinder humanitarian aid to the occupied territory of Gaza, specifically by physically obstructing the passage of aid trucks at border checkpoints monitored by the Israeli military. UFJP civil lawsuit alleges complicity in genocide and incitement to commit genocide, targeting two individuals identified as having French nationality, linked to two French organisations, namely the pro-Israel groups Israel is Forever and Tzav-9.
The National Anti-Terrorism Prosecutor’s Office has issued a preliminary indictment citing ‘serious and consistent indications’ of complicity in genocide and incitement to genocide in Israel, Egypt, and Gaza, particularly at the Nitzana and Kerem Shalom border crossings, during the period from January to May 2024. Another civil lawsuit, which was submitted in November 2024 by the Lawyers for Justice in the Middle East organisation and the Coordination of Appeals for a Just Peace in the Middle East (CAPJPO) – Europalestine, had already alleged “complicity in genocide.” further accusing officials from Israel is Forever of obstructing humanitarian vehicles, supported by photographs, videos, and public declarations. Undoubtedly, this lawsuit added weight to the Jewish Union for Peace’s complaint.
Israel faces growing international pressure to end the war in Gaza, which has claimed over 54,600 Palestinian lives, mostly civilians. Benjamin Netanyahu and former Defense Minister Yoav Gallant are subject to arrest warrants issued by the International Criminal Court for crimes against humanity.. Gaza: French court opens investigation into complicity in genocide after humanitarian aid blockades
The French National Anti-Terrorism Prosecutor’s Office (PNAT) has opened a judicial investigation into complicity in genocide, incitement to genocide, and complicity in crimes against humanity. It notably targets several French-Israelis suspected of having participated in actions blocking humanitarian aid intended for the population of Gaza between January and May 2024, Agence France-Presse has learned.
This court decision follows two civil action lawsuits filed in November 2024. One was filed by the French Jewish Union for Peace (UJFP) and a Franco-Palestinian victim. The other was filed by the associations Lawyers for Justice in the Middle East and the Coordination of Appeals for a Just Peace in the Middle East (CAPJPO-Europalestine).
The facts denounced concern actions aimed at physically preventing the passage of humanitarian aid trucks at the Nitzana and Kerem Shalom border crossings, controlled by the Israeli army. These actions are attributed to members or supporters of the groups “Israel is forever” and “Tzav-9“, presented as pro-Israeli and some of whose members are said to be of French nationality. The complaint filed by CAPJPO-Europalestine is based in particular on images and public statements showing blocking actions carried out by pro-Israeli activists.
” We are very satisfied with this decision, which is perfectly consistent with the factual and legal demonstrations and the objective evidence provided by the civil parties ,” UJFP lawyers Damia Taharraoui and Marion Lafouge told AFP. According to them, the period covered by the investigation, from January to May 2024, ” corresponds to a time when no one wanted to hear about genocide .”
Other similar procedures in several countries in Europe
This French judicial initiative comes as Israel is under increasing international pressure to end its military campaign in Gaza (…). Similar procedures have been initiated in several European countries, including Switzerland, the Netherlands and Germany.
Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant are also the subject of an arrest warrant request from the International Criminal Court for war crimes and crimes against humanity. In January 2024, the International Court of Justice had already called on Israel to ” prevent any act of genocide .” And last May, the UN’s humanitarian chief called on world leaders to “ act to prevent genocide.”
