As fiery clashes continue to engulf parts of Los Angeles, California Governor Gavin Newsom escalated the political and constitutional showdown with President Donald Trump on Sunday by announcing plans to sue the federal government over what he described as an unauthorized and unconstitutional deployment of National Guard troops.
The announcement came during a live MSNBC interview as chaos unfolded across downtown LA: cars set ablaze, fireworks launched at officers, and rocks hurled from overpasses at law enforcement. While President Trump framed the deployment as an urgent measure to protect federal agents during immigration raids, Newsom accused the administration of manufacturing the very crisis it claimed to solve.

In a direct appeal to Trump, Newsom challenged both the legality and the morality of the federal move. “It’s illegal and unconstitutional … It’s immoral,” he said. “You’re creating the conditions that you claim you’re solving.” His core argument centers around the unprecedented federalization of California’s National Guard without the governor’s request—a break with long-standing constitutional precedent that states control their own Guard units unless Congress explicitly authorizes a transfer of command.
The White House ordered 2,000 National Guard troops into the Los Angeles area on Friday night following a surge in violent protests sparked by a new wave of ICE raids. But Newsom says that bypassing state authority crossed a constitutional red line.
“This is a serious moment,” he said. “We will do everything in our power to stand up and stand in your way.”
The unrest began Friday with ICE raids across Los Angeles, targeting locations like the Fashion District and a Home Depot parking lot. As news of the raids spread, protests erupted and rapidly grew in size and aggression. What began as daytime demonstrations in downtown LA, Compton, and Paramount morphed into overnight riots marked by arson and assaults on federal and local law enforcement.
Los Angeles Mayor Karen Bass, standing in solidarity with Newsom, accused the federal government of deliberately escalating the situation. “This is about another agenda,” she stated. “This isn’t about public safety.”
Legal experts note that while the Insurrection Act gives the President some authority to federalize state troops, the law has rarely been used in peacetime domestic scenarios—and never without extreme political fallout. Newsom’s lawsuit could challenge the federal government’s interpretation of emergency powers, pitting state sovereignty against presidential authority in a case likely to climb to the Supreme Court.
Meanwhile, Trump has shown no signs of backing down. He has repeatedly called the unrest in Los Angeles an “invasion,” arguing that law and order must be restored. His administration claims the Guard deployment is necessary to allow federal agents to safely carry out deportations, some of which involved convicted criminals and gang affiliates.
