In a stunning escalation of the political and constitutional fallout following revelations about former President Joe Biden’s cognitive health, President Donald Trump signed a presidential memorandum Wednesday night ordering a formal investigation into who was actually running the executive branch during Biden’s final years in office.
The directive marks a historic moment — a sitting president launching an executive probe into the legitimacy of a predecessor’s actions on the basis of alleged incapacity.
The memorandum comes on the heels of bombshell reporting in Original Sin, the newly released book by CNN’s Jake Tapper and Axios’s Alex Thompson, which chronicles Biden’s dramatic mental decline during his time in the White House.
According to the Trump administration’s statement, the probe will focus on whether “certain individuals conspired to deceive the public” and unconstitutionally wielded executive power on Biden’s behalf — a scenario that would violate the core tenets of Article II of the Constitution.
One of the more shocking components of the directive is its focus on Biden’s use of an autopen — a mechanical signature device that the administration reportedly used for the majority of executive actions in Biden’s later years.
The memorandum demands answers regarding who authorized the autopen’s use, whether it was employed legally, and what that means for the legitimacy of over 1,200 presidential documents, including executive orders, judicial nominations, and pardons.
According to the Trump White House, the review will zero in on:
- 1,200+ presidential actions allegedly signed via autopen
- 235 federal judicial appointments, including appellate judges
- A controversial wave of commutations in Biden’s final month, including 37 convicted death row inmates
- Key domestic and foreign policy directives issued when Biden was reportedly “incapacitated”
The memorandum also questions whether Biden himself approved these actions, or if senior staff — possibly including his wife, Jill Biden, and top aides — assumed the role of de facto president.
This probe arrives amid a wave of Democratic defections. While many initially dismissed concerns over Biden’s health as partisan noise, the aftermath of the June debate — where Biden appeared confused, hesitant, and even froze mid-sentence — shattered the illusion of control. Public pressure and internal polling quickly pushed Biden to exit the 2024 race, endorsing Vice President Kamala Harris as his successor.
What’s more, reports in Original Sin describe White House aides openly debating whether to place Biden in a wheelchair just weeks after the 2020 election. These accounts, now corroborated by staff interviews, raise grave constitutional questions about how long Biden was capable of serving — and who was making decisions when he couldn’t.
