A Nevada judge made headlines months ago after she was attacked by a violent offender in a now viral courtroom video.
She has garnered attention again for dismissing the “fake electors” case tied to the 2020 presidential election, dealing a major win for Trump.
Clark County District Court Judge Mary Kay Holthus threw out Nevada’s indictment against six Republicans accused of illegally submitting certificates to Congress certifying Trump as the winner of the 2020 election.
Fox News reported she ruled Friday that Nevada Attorney General Aaron Ford’s office, led by a Democrat, filed the case in the wrong venue.
Holthus canceled the January trial for defendants including Clark County Republican Party chairman Jesse Law; national party committee member Jim DeGraffenreid; national and Douglas County committee member Shawn Meehan; Storey County clerk Jim Hindle; and Eileen Rice, a party member from the Lake Tahoe area.
Meehan is the only defendant in Nevada not named as a delegate to the 2024 Republican National Convention next month in Milwaukee, Fox noted.
All six Republicans faced charges of offering a false instrument for filing and uttering a forged instrument; each felonies carrying up to five years in prison.
Defense attorneys declared the case dead, citing a three-year statute of limitations that expired last December.
A spokesperson for Ford’s office announced plans to appeal the decision immediately.
Fox further noted that Clark County, where Holthus presides, is Nevada’s largest county.
It includes Las Vegas, the state’s most Democratic-leaning city.
Richard Wright, representing state GOP chairman Michael McDonald, criticized Ford for bringing the case before a grand jury in Las Vegas.
He argued that it should have been brought in a more Republican region where the alleged fraudulent documents were signed and submitted, Fox reported.
“What exactly occurred here to give us jurisdiction?” Holthus asked during the hearing.
“I mean, let’s face it, the majority of this happened elsewhere, the way I read it,” she added, as outlined by the New York Times.
Holthus determined that despite McDonald and Law living in Las Vegas, “everything took place up north.”
“Forum shopping? Absolutely,” said Monti Jordana Levy, a lawyer for Rice.
Fox highlighted that Nevada is one of seven battleground states where prosecutors filed “fake elector” cases related to Trump’s 2020 campaign.
Similar cases in Georgia and Washington, DC, have also faced delays.
Holthus was a part of a viral video earlier this year when she was prepared to sentence defendant Deobra Redden for a battery charge in an unrelated case.
Redden denied bond, then flew over the bench and attacked Holthus.
He grabbed her hair before being subdued by her clerk and court officers, footage shows.
The incident left several injured, but Holthus returned to work the next day, Fox reported.
Redden was later indicted on nine charges, including attempted murder. His attorney pleaded not guilty by reason of insanity.
The clip was so chaotic and alarming that Judge Judy said, “I was shocked he was able to get as far as he did without someone shooting him!”
