The crooked Department of Justice is out flexing its muscles again as it threatens to sue Tiktok’s ByteDance over a violation of children’s privacy, Bloomberg News reported on Thursday.
According to the news outlet, the DOJ will submit a consumer protection lawsuit against the Chinese-owned company on behalf of the Federal Trade Commission later this year.
Sources remarked that the Justice Department will pursue this case instead of their earlier lawsuit, which alleges that the company misled American users on data security.
Furthermore, the Justice Department will remove a portion of the complaint, which accuses TikTok of deceiving its users by not informing them that China-based employees of ByteDance will have access to their private information.
DOJ, FTC, or TikTok have not made comments on the issue.
Reuters published a report earlier revealing that the FTC has already filed a complaint against Tiktok and ByteDance.
In a statement, the FTC remarked that they have “uncovered reason to believe” that these companies are “violating or are about to violate” the Children’s Online Privacy Protection Act.
The Children’s Online Privacy Protection Act is a federal law prohibiting apps and websites from collecting the personal information of kids under 13 years old without their parental consent.
Reports say that the FTC has now referred the complaint to the Justice Department, and it’s now the DOJ’s call if they will pursue the Chinese-owned companies.
The FTC asserts that the matter is “in the public interest,” which required them to publicize their complaint submitted to the DOJ.
“Consistent with our normal approach, the Justice Department consulted with the FTC in advance of this referral and will continue to do so as we consider the claims,” a DOJ spokesperson said.
“As always, the Department will be guided by the facts and the law, as well as our responsibility to protect the American people.”
This complaint is different from the recently approved divestment or ban bill that requires ByteDance to sell TikTok by January or be blocked in the US.
The Chinese-owned company is currently challenging the law.
Meanwhile, ByteDance, in a statement on Thursday, said that without the court overturning the decision, the ban would be inevitable.
Meanwhile, some X users questioned whether Mark Zuckerberg’s Meta is also committing children’s privacy violations, suggesting that Biden’s federal government may be selectively prosecuting TikTok and ByteDance.
TikTok has said it strongly disagrees with the FTC’s allegations and is disappointed the agency decided to pursue a lawsuit.
