Interim U.S. Attorney for the District of New Jersey Alina Habba launched a scathing attack against two Republican senators during a Sunday appearance on Fox News.
Habba directly confronted Senate Judiciary Committee members who have blocked her confirmation process for months while she continues serving in the critical law enforcement position.
The interim attorney currently oversees a high-profile federal case against U.S. Rep. LaMonica McIver, a New Jersey Democrat facing serious charges for alleged assault on a federal officer.
Her path to confirmation has encountered multiple significant obstacles since taking the interim position earlier this year.
Resist the Mainstream reported last week that U.S. District Judge Matthew Brann, appointed during the Obama administration, delivered a comprehensive 77-page ruling Thursday declaring that Habba lacks legal authority to hold her current position.
The federal judge stated that Habba has operated without proper legal standing since July 1, creating an unprecedented constitutional challenge for the administration.
Previous attempts by district judges to remove her from office occurred in July, but President Trump intervened with strategic legal maneuvers to extend her tenure for an additional 120 days on an interim basis.
The legal battles have created uncertainty within the New Jersey federal prosecutor’s office while Habba continues handling major criminal cases.
Republican senators on the Senate Judiciary Committee now stand as the primary barrier to her confirmation, according to Habba’s detailed statements to Fox News host Maria Bartiromo.
The confirmation process has stalled despite the administration’s push to install loyal prosecutors who will advance the president’s law-and-order agenda.
Bartiromo highlighted the specific opposition from Sen. Thom Tillis (R-NC), explaining his public stance against advancing nominees without following traditional procedural requirements known as blue slips.
“Thom Tillis, a member of the Judiciary Committee, has stated publicly that if Chairman Grassley tried moving a district judge or US attorney through the Judiciary Committee without a blue slip, he would oppose that nominee,” Bartiromo noted during the interview.
The host emphasized that Tillis’s opposition would automatically align with Democratic votes, effectively preventing the nomination from advancing out of committee to a full Senate vote.
This procedural roadblock has frustrated Trump administration officials who argue that traditional Senate customs should not override presidential appointment powers.
Habba dismissed Tillis’s stance as entirely predictable, characterizing his opposition as “not surprising” given his previous resistance to Trump nominees.
She argued that Republican senators prioritize maintaining internal relationships and Senate traditions over supporting the president’s clear mandate from American voters.
“You know, they’re trying to look at this as they all need to get along to go along, but they’re not looking at what this does. The president was rightfully voted in by a majority of Americans, and he is entitled to pick his U.S. attorneys, his Department of Justice officials, his judges, so that we can continue the agenda that the American public voted for, which is to get rid of crime,” she stated emphatically.
Habba defended her office’s impressive record by citing specific law enforcement statistics from recent New Jersey operations that demonstrate her effectiveness in combating crime.
“In the state of New Jersey in June alone, we arrested over 300 criminals, illegals, rapists. What is so bad about that work?” she questioned, highlighting the concrete results her office has achieved.
The arrest numbers represent a significant increase in federal law enforcement activity within the district since she assumed the interim position.
She characterized the senatorial opposition as purely politically motivated rather than based on her demonstrated performance, qualifications or the needs of New Jersey residents.
“The truth is, it has nothing to do with the work that we’re doing. It has nothing to do with the crime that we’re stopping. It has to do with trying to prevent President Trump from continuing his agenda, and it has to stop,” Habba declared with visible frustration.
The interim attorney escalated her criticism by naming both Senators Tillis and Chuck Grassley (R-IA) directly as significant obstacles to the administration’s law enforcement objectives.
Her decision to publicly call out fellow Republicans represents an unusual breach of typical political protocol between executive and legislative branches.
“So I would say to Senator Tillis and Senator Grassley, you are becoming part of the issue. You are becoming part of the antithesis of what we fought for four years, the same reason Tish James just got overturned in the appellate division, because it was a hoax, and it was misused and abusive power and we cannot allow and promote that kind of behavior,” she stated.
Habba’s reference to Tish James connects her confirmation battle to broader concerns about prosecutorial overreach that Trump supporters have criticized.
The interim attorney expanded her argument beyond personal concerns, framing the confirmation battle as affecting federal prosecutors nationwide who support the Trump administration’s crime-fighting priorities.
“It is not just about me, it is about people across the country, US attorneys across the country that just want to do right by Americans that voted for President Trump,” she concluded during the interview.
Her comments reflect growing tension between Trump loyalists and establishment Republicans who maintain traditional Senate procedures.
Sen. Tillis announced his retirement plans earlier this summer after previously blocking Trump’s controversial nominee for D.C. U.S. attorney position, Resist the Mainstream reported.
The outgoing senator has publicly pledged to oppose nominees he considers unqualified or inappropriate, particularly targeting those who have advocated for individuals involved in January 6 proceedings.
