While running for office last year, President Donald Trump promised to take action against so-called “sanctuary” jurisdictions which defy federal immigration law.
While Trump opted to slash their funding, an Obama-appointed judge has just issued an injunction reversing that move.
Friday order builds on an earlier injunction which judge issued in April
According to Breitbart, that order was issued by U.S. District Judge William Orrick this past Friday and it expanded upon an earlier injunction he put forward in April.
That injunction came in response to a lawsuit filed by San Francisco which has since been joined by a collection of other Democrat run jurisdictions.
They are St. Paul, Minnesota, New Haven, Connecticut; Portland, Oregon; Santa Fe, New Mexico; and Seattle, Washington.
At issue is an executive order the president signed shortly after his inauguration titled “Protecting the American People Against Invasion.”
Orrick ruled that funding ban was a violation of the Constitution’s 10th Amendment
It barred “so-called ‘sanctuary’ jurisdictions, which seek to interfere with the lawful exercise of Federal law enforcement operations” from receiving access to federal funds.
However, Orrick concluded that this prohibition violates the separation of powers doctrine which is laid out in the Constitution’s 10th Amendment.
“The threat to withhold funding causes them irreparable injury in the form of budgetary uncertainty, deprivation of constitutional rights, and undermining trust between the Cities and Counties and the communities they serve,” Orrick asserted in his April injunction.
Breitbart pointed out that for its part, the Trump administration has already filed an appeal of the judge’s earlier injunction.
DOJ is suing multiple sanctuary cities, including Los Angeles and Portland
Meanwhile, the Department of Justice (DOJ) announced on August 5 that it “has filed several lawsuits against sanctuary jurisdictions,” including major cities like Los Angeles, California along with Portland, Oregon.
Today, the Justice Department published a list of states, cities, and counties identified as having policies, laws, or regulations that impede enforcement of federal immigration laws.

“Sanctuary policies impede law enforcement and put American citizens at risk by design,” Attorney General Pam Bondi declared in a statement.
“The Department of Justice will continue bringing litigation against sanctuary jurisdictions and work closely with the Department of Homeland Security to eradicate these harmful policies around the country,” the attorney general went on to add.
