Securing the release of their exalted “Maryland man” could prove a hollow victory for the left, as a court-ordered notice detailed which third-party country ICE intended to send the illegal alien.
Friday, Kilmar Abrego Garcia, the purported MS-13-affiliated Salvadoran national facing federal charges for alleged human smuggling, was released from custody while awaiting trial. The same day that he was transported back to Maryland, U.S. Immigration and Customs Enforcement (ICE) and the Department of Homeland Security (DHS) notified the illegal alien that he may actually be en route to Uganda within days.
Sharing the documents from the federal government, Fox News national correspondent Bill Melugin posted to X Friday, “Per DHS & ICE sources, this afternoon, DHS notified Kilmar Abrego Garcia’s counsel via email that ICE may deport Abrego Garcia to Uganda ‘no earlier than 72 hours from now’, & ICE is also ordering him to report to ICE’s Baltimore office on Monday.”
Abrego Garcia’s legal team was told, “Pursuant to the court order issued in the District Court of Maryland on July 23, 2025, … please let this email serve as notice that DHS may remove your client, Kilmar Armando Abrego Garcia, to Uganda no earlier than 72 hours from now (absent weekends).”

As had been reported, then-President Barack Obama-appointed U.S. District Judge Paula Xinis had issued an emergency ruling in July requiring the delay of 72 hours while insisting it was a matter of “due process.”
“Separately, the requested notice is necessary to prevent a repeat of Abrego Garcia’s unlawful deportation to El Salvador by way of third-country removal,” the judge had contended while criticizing the actions of immigration enforcement. “Defendants have taken no concrete steps to ensure that any prospective third country would not summarily return Abrego Garcia to El Salvador in an end-run around the very withholding order that offers him uncontroverted protection.”

While innocence is maintained until proven guilty in a court of law, human and firearm smuggling weren’t the only allegations that had been brought against Abrego Garcia as the left cheered his return to his wife and children in Maryland.
As Melugin pointed out, the illegal alien’s wife “has repeatedly accused him in court of beating her,” and DHS Secretary Kristi Noem reacted to the release, “Activist liberal judges have attempted to obstruct our law enforcement every step of the way in removing the worst of the worst criminal illegal aliens from our country. Today, we reached a new low with this publicity hungry Maryland judge mandating this illegal alien who is a MS-13 gang member, human trafficker, serial domestic abuser, and child predator be allowed free.”

“By ordering this monster loose on America’s streets, this judge has shown a complete disregard for the safety of the American people,” the secretary continued. “We will not stop fighting till this Salvadoran man faces justice and is OUT of our country.”

Likewise, White House deputy press secretary Abigail Jackson spoke to the conditional release in a statement on X, saying, “Abrego Garcia is a criminal illegal alien, wife-beater, and and MS-13 gang member facing serious charges of human smuggling. He will face justice for his crimes. It’s an insult to his victims that this left-wing magistrate intervened to put him back on the streets. Garcia will be subject to ankle monitoring to ensure the safety of the American public until further action can be taken.”

As for his potential destination, Uganda had come to a “temporary arrangement” with the United States that had been announced by the nation’s foreign affairs ministry on Thursday, making it the second East African nation, after Rwanda, to align with President Donald Trump’s deportation efforts.
Ugandan Permanent Secretary of Foreign Affairs Ministry Vincent Bagiire Waiswa had said, “The Agreement is in respect of Third Country Nationals who may not be granted asylum in the United States but are reluctant to or may have concerns about returning to their countries of origin.”
Despite the backlash for his PR trip to El Salvador while Abrego Garcia had been incarcerated there, Maryland Sen. Chris Van Hollen (D) maintained his defense of the illegal alien and stated in part, “While I have no doubt the Administration will continue its attempts to undermine Mr. Abrego Garcia’s rights, we will continue fighting to see them maintained — because due process in this case does not end with his release.”
Additionally, the senator advanced the argument that all illegal aliens, who leftist open border policies had been integral in allowing into the country, should be allowed their day in court, “where the Trump Administration must make its case before taking any further action against him. This is a matter that’s greater than just this one case or one man — if one person’s rights are denied, then the rights of all of us are at risk.”
