Kilmar Abrego Garcia, an illegal alien from El Salvador who is an alleged MS-13 gang member, human trafficker, and domestic abuser, became a cause célèbre for Democrats and the media when an “administrative error” resulted in his being mistakenly deported to and imprisoned in his home country in March.
Garcia was just ordered released from a Tennessee jail, where he has been held on federal charges since his return to the U.S. in June, but his leftist supporters shouldn’t get too excited because he faces the strong likelihood of imminent deportation to another country, according to the New York Post.
Indeed, sources indicated that Garcia could soon be deported to the African nation of Uganda, which recently agreed to accept third-country deportees from the U.S.
Ordered released by a judge
NBC News reported on Friday that U.S. Magistrate Judge Barbara Holmes in Tennessee ordered Garcia released from the Nashville jail where he has been in custody since June, and granted him 48 hours to return to his family in Maryland, while escorted by private security, where he is to reside at his brother’s home under certain limiting conditions, including wearing an ankle monitor.
He is also required to check in on Monday with the U.S. Immigration and Customs Enforcement field office in Baltimore under a restored Order of Supervision that stemmed from a 2019 court order that found him deportable to anywhere other than his home nation of El Salvador, given a credible fear of violence from rival gangs.
Garcia’s release had been delayed for 30 days at the request of his own attorneys over concerns that he might be immediately reapprehended and deported once again by ICE, though those fears were allayed somewhat by the intervention of a separate judge in Maryland in July who demanded that ICE give Garcia 72 hours notice and an opportunity to file legal challenges before being taken into custody again and deported.
Still faces risk of likely deportation to a third country
In a statement issued upon his release, Garcia said, in part, “Today has been a very special day because I have seen my family for the first time in more than 160 days,” and added, “Today I am grateful to God because He has heard me and today I am out. We are steps closer to justice, but justice has not been fully served.”
One of his attorneys, Simon Sandoval-Moshenberg, took a more cautious tone and said, “While his release brings some relief, we all know that he is far from safe. ICE detention or deportation to an unknown third country still threaten to tear his family apart. A measure of justice has been done, but the government must stop pursuing actions that would once again separate this family.”
The lawyer was right to express concern that his client’s freedom may be rather limited, as Fox News reporter Bill Melugin shared on Friday that, according to his sources, the process to deport Garcia once more had already begun.
In an X post, Melugin wrote, “Per DHS & ICE sources, this afternoon, DHS notified Kilmar Abrego Garcia’s counsel via email that ICE may deport Abrego Garcia to Uganda ‘no earlier than 72 hours from now’, & ICE is also ordering him to report to ICE’s Baltimore office on Monday.”
Administration not happy about Garcia’s release
While notice has reportedly already been sent of Garcia’s imminent deportation, NBC News reported that the Trump administration was still furious that he had been ordered released from federal custody in the first place.
White House spokesperson Abigail Jackson said, “Abrego Garcia is a criminal illegal alien, wife-beater, and an MS-13 gang member facing serious charges of human smuggling. He will face justice for his crimes.”
“It’s an insult to his victims that this left-wing magistrate intervened to put him back on the streets,” she added. “Garcia will be subject to ankle monitoring to ensure the safety of the American public until further action can be taken.”
Likewise, Homeland Security Secretary Kristi Noem wrote in an X post, “Activist liberal judges have attempted to obstruct our law enforcement every step of the way in removing the worst of the worst criminal illegal aliens from our country. Today, we reached a new low with this publicity-hungry Maryland judge mandating this illegal alien, who is a MS-13 gang member, human trafficker, serial domestic abuser, and child predator, be allowed free.”
“By ordering this monster loose on America’s streets, this judge has shown a complete disregard for the safety of the American people,” the secretary added. “We will not stop fighting till this Salvadoran man faces justice and is OUT of our country.”
