An appellate court just gave President Donald Trump and his administration the okay to terminate the Temporary Protected Status (TPS) of tens of thousands of illegal immigrants currently residing in the United States.
Breitbart News reports that the United States Court of Appeals for the Ninth Circuit issued its ruling on Wednesday.
In the process of doing so, the court overturned the decision of Judge Trina Thompson of the U.S. District Court for the Northern District of California. Thompson is a Biden appointee.
The appellate court decision was 3 to 0.
Background
The U.S. Department of Homeland Security (DHS), under the leadership of President Trump and Homeland Security Secretary Kristi Noem, has been looking to end the TPS for about 60,000 migrants.
Back in July, Noem released a statement, saying:
Temporary Protected Status was designed to be just that — temporary. It is clear that the Government of Honduras has taken all of the necessary steps to overcome the impacts of Hurricane Mitch, almost 27 years ago. Honduran citizens can safely return home, and DHS is here to help facilitate their voluntary return. Honduras has been a wonderful partner of the Trump Administration, helping us deliver on key promises to the American people. We look forward to continuing our work with them.
Unsurprisingly, the move was immediately challenged in the courts by pro-immigration groups, and they got an early victory.
Earlier this month, The Hill reported:
San Francisco-based U.S. District Judge Trina Thompson agreed the plaintiffs had shown there was sufficient racial animus behind the decision and that the Trump administration had failed to undertake an “objective review of the country conditions” before ending protections.
You read that correctly. Thompson claimed that the Trump administration was primarily driven by “racial animus.”
The latest
The Trump administration proceeded to appeal Thompson’s decision, which is how the case got to the Ninth Circuit, and, as mentioned, the Ninth Circuit has now given the Trump administration a big win.
The New York Post reports:
In a unanimous decision, the three-member panel of judges on the 9th US Circuit Court of Appeals halted a lower court order that had blocked the Trump administration from eliminating temporary deportation protections and revoking work permits from the migrants.
The outlet goes on to quote the court.
It reports:
“The government’s motion for a stay pending appeal … is granted,” Circuit Judges Michael Hawkins ( a Bill Clinton appointee), Consuelo Callahan (a George W. Bush appointee) and Eric Miller (Trump appointee) wrote in their brief, two-page ruling, which did not explain the decision.
It is unclear, at the time of this writing, whether we will see an appeal to the U.S. Supreme Court.
