A longtime Democratic intelligence staffer on the House Intelligence Committee warned the FBI in 2017 that Rep. Adam Schiff, now a California senator, approved leaking classified information to harm President Donald Trump during the Russiagate probe.
FBI memos recently obtained by Congress through Director Kash Patel detail claims that Schiff directed illegal leaks for political gain.
The whistleblower, a Democrat connected to both Schiff and former Republican committee chairman Devin Nunes, described the leaks as “unethical,” “illegal” and “treasonous.”
Schiff reportedly assured staff he was protected by the Constitution’s speech and debate clause, but no formal legal opinion confirms such immunity applies to the leaks.
FBI 302 documents reviewed by Just the News show the whistleblower attended a staff meeting where Schiff allegedly said the group would release damaging classified information to indict Trump.
Although concerned about legality, the whistleblower was told others would avoid repercussions.
The whistleblower raised these concerns repeatedly from 2017 through 2023. Despite multiple interviews, the Department of Justice (DOJ) declined prosecution, citing legislative immunity.
Some officials who rejected charges still hold influential DOJ positions.
Patel condemned the politicization of intelligence, stating, “For years, certain officials used their positions to selectively leak classified information to shape political narratives… to weaponize intelligence and law enforcement for political gain.”
He added, “The FBI will now lead the charge, with our partners at DOJ, and Congress will have the chance to uncover how political power may have been weaponized and to restore accountability.”
The whistleblower also revealed Schiff’s office controlled who could leak sensitive information. After refusing participation over insufficient party loyalty, the whistleblower was abruptly fired.
A Republican staffer confirmed the dismissal was sudden and linked to the refusal.
Rep. Eric Swalwell (D-CA) was named as a suspected leak source. The whistleblower pointed to a highly sensitive mid-2017 document leaked soon after review by Schiff, Swalwell and others.
The whistleblower described a shift in the House Permanent Select Committee on Intelligence during the 2016 election, with Democrats viewing Trump’s victory as a “constitutional crisis.”
Schiff expected to be CIA director if Hillary Clinton had won and was notably upset by Trump’s win.
Leaking classified information and influencing the media aimed to push for a Joint Inquiry into Russian interference similar to the 9/11 Commission. The whistleblower told FBI agents the leaks sought to “topple the administration” and address the perceived crisis.
Schiff has continued promoting the Steele dossier despite its discreditation.
He maintained claims of Trump-Russia collusion after special counsel Robert Mueller’s 2019 report found no criminal wrongdoing.
The DOJ Inspector General revealed multiple failures in the FBI’s Crossfire Hurricane investigation, including withholding exculpatory evidence and relying on politically motivated Steele research.
In 2023, the House censured Schiff for spreading false allegations from the Steele dossier and wrongly accusing Trump associates of collusion.
In January 2025, then-President Joe Biden pardoned Schiff for actions related to the Jan. 6 committee, a move Schiff called “unwise and unnecessary” but attributed to politically motivated prosecution threats, according to Just the News.
These FBI memos emerge amid ongoing congressional probes into politicization of intelligence and law enforcement during the Trump presidency, underscoring unresolved questions about accountability for unauthorized leaks.
