America has another Sanctuary City for the Unborn in Northeast Texas. On Tuesday, August 11th, the City Council of Talco, Texas (pop. 494) unanimously passed an ordinance further outlawing abortion in their community, and declaring their city a “Sanctuary City for the Unborn.” The 2-0-1 vote made the City of Talco, located on United States Hwy 271 between the cities of Bogota (pop. 1,153) and Mount Pleasant (pop. 16,275) in Northeast Texas, the 62nd city in the State of Texas and the 79th city in the nation to pass an ordinance banning abortion. The Talco City Council first heard about the opportunity to pass the measure at their Monday, July 14th meeting.
The Talco Sanctuary City for the Unborn Ordinance, which is enforced through a private right of action – just like the Texas Heartbeat Act, (1) prohibits performing an elective abortion and aiding or abetting elective abortions within the city limits of Talco, (2) prohibits elective abortions on residents of Talco – regardless of where the abortion takes place, (3) prohibits abortion trafficking through the City of Talco, (4) prohibits the mailing of abortion-inducing drugs into the City of Talco, (5) prohibits criminal organizations from doing business inside the city limits of Talco, and (6) prohibits through or in the City of Talco the transportation and disposal of the remains of unborn children who have been killed by an elective abortion across state lines and carried into Texas by waste management companies. The Talco Sanctuary City for the Unborn Ordinance also educates about the Thriving Texas Families Program and directs people to the Texas Pregnancy Care Network website and The Pregnancy Network website operated by Human Coalition for pregnancy and family resources.

Prior to the vote, City Commissioner Mars shared, “Since I’ve been on the City Council, I’ve had a goal to make decisions that I believe will improve the quality of life as best as I can for the people who live here in our community . . . But without life, there can’t be liberty or the pursuit of happiness. There can’t be quality of life without life itself.” Commissioner Mars continued, “if this ordinance will help to keep someone from making a tragic decision they will regret for the rest of their lives, or gives someone the ability to seek justice when their child has been exploited by some organization or some clinic from some other state, then, to me, this ordinance is about life. So I’m going to choose life and I pray that the Good Lord will help us continue to work to improve the quality of life for people of all ages who live here.”
Commissioner Cindy Watts was in agreement with Commissioner Mars, stating, “I believe God is the one who makes the decision to give life, and I want to protect the life that God gives.” With both city commissioners supporting the measure, Mayor Shirley Caruthers chose to abstain since her vote was not needed to break a tie.
The City of Talco is the fifth political subdivision to have passed a Sanctuary for the Unborn” ordinance during Texas Governor Greg Abbott’s first special session of the 89th Texas Legislature, where he has called for the Texas Legislature to pass legislation further protecting pregnant mothers and their unborn children from the harm of abortion.
The City of Talco is the first political subdivision in Titus County to consider the passage of a Sanctuary for the Unborn Ordinance. On February 14th, 2022, the Titus County Commissioners’ Court passed a resolution on February 14th, 2022 titled a “Resolution of the Titus County Commissioners Court, Declaring the County of Titus, Texas to be a Sanctuary for the Unborn and Urging the Citizens of Titus County to Promote and Defend the Unalienable Right To Life and the Inherent Dignity of All Human Beings, Including the Pre-Born, from Conception or Fertilization through All Stages of Development.” In the resolution, the Titus County Commissioners’ Court resolved to present an ordinance in order to enforce the intent of such resolution “by any means within its power,” in accordance with its responsibility as the people’s elected local representatives. The Titus County Commissioners Court is expected to consider a Sanctuary County for the Unborn ordinance in the near future. Over the past year, several political subdivisions throughout Texas have been considering the passage of such measures, including the cities of Hallettsville (pop. 2,756), Moulton (pop. 886), Albany (pop. 2,043) and Leary (pop. 605).
