Newly uncovered documents obtained via a Freedom of Information Act (FOIA) lawsuit have revealed that Jeffrey Epstein served as an FBI informant before the 2007 non-prosecution agreement that allowed him to avoid federal sex trafficking charges.
The findings shed new light on the nature and extent of Epstein’s involvement with U.S. intelligence and raise further questions about why he received lenient treatment from federal prosecutors.
Epstein, who died in jail in 2019 while awaiting trial on sex trafficking charges, had been cooperating with the FBI as early as 2008, according to an internal cable from the bureau dated September 9, 2008.
The cable, marked “ROUTINE,” includes a redacted special agent’s statement: “Epstein has also provided information to the FBI as agreed upon.”
The document further states, “Case agent advised that no federal prosecution will occur in this matter as long as Epstein continues to uphold his agreement with the State of Florida.”
This information reveals that Epstein’s relationship with the FBI began earlier than previously understood.
It challenges the narrative that Epstein’s plea deal was solely the product of powerful legal maneuvering and instead suggests he provided actionable intelligence to federal authorities.
The 2007 non-prosecution agreement allowed Epstein to plead guilty to lesser state charges involving the solicitation of prostitution from a minor.
He served 13 months in a Palm Beach jail, much of it under a work-release arrangement that allowed him to leave the facility for up to 12 hours a day, six days a week.
The plea deal also included extraordinary language that granted immunity to “any potential co-conspirators,” including both known and unknown individuals.
Legal experts have said such terms are virtually unheard of in similar federal cases.
Alexander Acosta, the then-U.S. Attorney for the Southern District of Florida who oversaw the deal, later claimed he had been instructed to back off Epstein.
Acosta stated, “I was told Epstein ‘belonged to intelligence’ and to leave it alone.”
These new records appear to support that assertion.
The full internal memo from the FBI reads: “On 9/11/08, case agent advised writer that Epstein is currently being prosecuted by the State of Florida and is complying with all conditions of his plea with the State of Florida.”
“Epstein has also provided information to the FBI as agreed upon. Case agent advised that no federal prosecution will occur in this matter as long as Epstein continues to uphold his agreement with the State of Florida.”
It continues, “Case agent also advised that no further forfeiture assistance will be required for this case. Case agent is requested to contact writer in the event this matter moves forward on a federal level.”
One intelligence agency source told Radar Online, “Epstein was more than just protected – he was a puppet, informant and spy for the FBI.”
A separate source close to the case described the documents as “smoking gun” evidence that Epstein’s cooperation was central to the decision not to pursue federal charges.
“These are the smoking gun documents. They show Epstein was an active source for the FBI way before his plea deal in 2007.”
The implications of this cooperation extend beyond Epstein himself.
The non-prosecution agreement extended immunity to several of Epstein’s alleged co-conspirators, including Sarah Kellen (now 45), Adriana Ross (41), Lesley Groff (54) and Nadia Marcinkova (39).
A legal source told Radar Online, “You don’t give this kind of deal to a man like Epstein unless you’re getting something big in return.”
The source added, “The real reason the FBI has been stonewalling for years is because these files blow up the official story. Epstein wasn’t just evading justice – he was helping them.”
