New Hampshire has made history by becoming the first New England state to ban “transgender” surgeries and hormone treatments for minors.
New Hampshire Gov. Kelly Ayotte (R) signed two bills into law Friday that prohibit the use of puberty blockers, cross-sex hormones, and sex-change surgeries for anyone under 18.
“These bills represent a balanced, bipartisan effort to protect children,” Ayotte said after signing House Bill 377 and House Bill 712 into law.
The new laws go into effect January 1, 2026. Under HB 377, doctors are barred from prescribing puberty blockers or cross-sex hormones to minors for the purpose of gender transition. The only exception is for those already undergoing treatment before the deadline.
The law also opens the door for lawsuits. Minors harmed by these procedures will be able to sue, and the state’s medical board will be empowered to take disciplinary action against any provider who violates the law.
HB 712 specifically targets chest surgeries, banning double mastectomies for girls and breast augmentation for boys unless the procedure is deemed medically necessary.
Conditions like cancer, infection, or congenital deformities are exempt, per Breitbart News.
Any doctor who performs banned surgeries could face legal action and have their license challenged. The law also classifies these surgeries as “unprofessional conduct.”
“This craze, it seems almost a cult-like following of this gender confusion,” said Republican State Senator Kevin Avard. “Biology speaks volumes.”
Avard pointed to emotional testimony from individuals who regretted undergoing these procedures. “They realized they did long-term and irreparable damage to their bodies. The testimony was overwhelming.”
Supporters of the bill say it’s about common sense and protecting vulnerable children from irreversible harm pushed by ideologically driven activists.
The legislation comes in the wake of a landmark U.S. Supreme Court ruling in United States v. Skrmetti, which upheld Tennessee’s ban on similar procedures. The Court found no Equal Protection Clause violation, clearing the way for states to move forward.
Tennessee Attorney General Jonathan Skrmetti said the ruling gives other states “a green light to protect kids without fear of being overturned in federal court.”
While the laws enjoy broad conservative support, LGBT advocacy groups have responded with outrage. “These laws are merciless, cruel, and painful,” claimed Courtney Reed of the ACLU of New Hampshire.
GLBTQ Legal Advocates and Defenders called the bills a “dangerous overreach,” arguing they undermine both families and medical professionals.
Chris Erchull, senior staff attorney at GLAD, said the laws “send a message that the legislature thinks it knows better than doctors and the families of transgender young people.”
He also warned that lawsuits could still be brought under the New Hampshire constitution or based on parental rights.
Despite the threats of legal action, Ayotte made clear the state is standing firm. The bills reflect growing momentum across red states to restrict access to irreversible gender procedures on minors.
