A formal investigation has been launched into former Special Counsel Jack Smith, the man behind both of President Donald Trump’s criminal cases under the Biden Department of Justice.
The Office of Special Counsel (OSC) confirmed the probe this week, marking a major development in the ongoing backlash against what many Republicans have called politically driven lawfare.
Smith led two high-profile investigations into Trump.
The first, regarding classified documents, was thrown out by Judge Aileen Cannon, who ruled Smith’s appointment violated constitutional requirements.
The second, centered on Trump’s 2020 election challenges, was partially dismantled by the Supreme Court’s ruling on presidential immunity. That case collapsed entirely after Trump won re-election in November.
According to an email obtained by the New York Post, the OSC’s Hatch Act Unit is conducting the investigation.
That unit enforces rules banning political activity by federal employees.
The email came from Senior Counsel Charles Baldis and confirmed the agency is formally reviewing Smith’s conduct, Trending Politics reported.
Arkansas Sen. Tom Cotton (R) reacted swiftly. “I appreciate the Office of Special Counsel taking this seriously,” Cotton said. “Jack Smith’s actions were clearly driven to hurt President Trump’s election, and Smith should be held fully accountable.”
Cotton’s letter to the OSC accused Smith of weaponizing his authority to undermine Trump’s 2024 campaign. “Jack Smith’s legal actions were nothing more than a tool for the Biden and Harris campaigns,” Cotton wrote on X. “This isn’t just unethical, it is very likely illegal campaign activity from a public office.”
Smith resigned shortly before Trump’s second inauguration in January.
He’s been heavily criticized by Trump allies for what they call “election interference.”
Trump himself has repeatedly blasted the prosecutions as illegitimate.
Senate Republicans previously sent a letter to Attorney General Pam Bondi outlining further allegations. Whistleblowers alleged Smith worked closely with Biden DOJ officials and anti-Trump FBI agents in an operation dubbed “Arctic Frost.”
“The emails also provide further support that ASAC Thibault played a central role in advancing its approval to a full field criminal investigation,” Iowa Sen. Chuck Grassley (R) wrote. “Other agents had concerns the supporting evidence only allowed for a preliminary investigation.”
The whistleblowers claim the Biden White House personally helped hand over the cell phones of both Trump and former Vice President Mike Pence, even though neither was a subject of the probe at that time.
Smith’s ties to Fulton County DA Fani Willis are also under scrutiny. Willis brought a now-defunct racketeering case against Trump over his Georgia election challenges. Both she and Smith claimed they acted independently, but communications between their offices later proved otherwise.
Republican lawmakers say Smith’s pattern of conduct exposes a coordinated campaign between the Biden DOJ, left-wing prosecutors, and federal agents to target Trump.
As Cotton put it, “No one is above the law — not even Jack Smith.”
