French President Emmanuel Macron and his wife, Brigitte Macron, have filed a defamation lawsuit in the United States against conservative American commentator Candace Owens.
The couple filed the 218-page complaint on Wednesday in Delaware, accusing Owens of spreading false claims that Brigitte Macron was born male and profiting from those allegations.
The lawsuit alleges that Owens falsely stated Brigitte Macron is actually Jean-Michel Trogneux, the French president’s brother, who she claims changed gender and identity to become Brigitte Macron.
Owens has repeatedly asserted this claim across her social media platforms and in podcast interviews, saying she would risk her “entire professional reputation on the fact that Brigitte Macron is in fact a man.”
The lawsuit outlines how Owens ignored multiple cease-and-desist letters and continued to make the statements, despite being told the information was false.
The Macrons’ legal team argues that Owens used the controversy to increase her audience and generate revenue through monetized content.
In a joint statement reported by the Financial Times, the Macrons said: “Because Ms Owens systematically reaffirmed these falsehoods in response to each of our attorneys’ repeated requests for a retraction, we ultimately concluded that referring the matter to a court of law was the only remaining avenue.”
Attorney Thomas Clare of Clare Locke LLP, a defamation-focused law firm, is representing the French first couple.
Clare said both Emmanuel and Brigitte Macron are willing to travel to Delaware and attend the trial in person to seek punitive damages.
He stated: “They believe it’s important to stand up for themselves… Owens has had multiple opportunities to do the right thing and in response she has only mocked them.”
The legal action marks a rare move by foreign heads of state to file a defamation lawsuit in the United States, where the legal threshold for public figures to prove libel is considerably high.
Breitbart News outlined that to win their case, the Macrons must demonstrate that Owens acted with “actual malice,” meaning that she either knowingly spread false information or showed reckless disregard for the truth.
The lawsuit not only targets claims about Brigitte Macron’s gender but also addresses conspiracy theories shared by Owens regarding President Macron.
One of the allegations denies that Macron was manipulated by the CIA’s MKUltra program.
The legal filing reads: “President Macron has not participated in, nor is he the product of, any government mind control programmes.”
Additionally, the Macrons addressed statements Owens allegedly made regarding the beginning of their relationship.
Owens reportedly implied that Brigitte Macron, then a teacher at Emmanuel Macron’s high school, had an inappropriate relationship with him while he was underage.
In their court filing, the Macrons stated that although Emmanuel Macron was 15 when they met and Brigitte was 39, their bond was initially intellectual and remained “within the bounds of the law.”
The relationship, according to the lawsuit, did not become romantic until years later.
The filing notes that in December 2023, the Macrons sent a formal letter to Owens, directly denying that any statutory rape had taken place and again affirming that Brigitte Macron is not transgender.
Despite this outreach, Owens continued to publicize her statements, which led to the decision to pursue litigation.
The Macrons are not new to defending their reputations through legal channels.
Breitbart further noted that in 2022, Brigitte Macron filed a defamation complaint in France against journalist Natacha Rey and self-proclaimed medium Amandine Roy, who had circulated similar gender identity rumors.
In 2023, a French court found the two guilty of libel and fined them approximately $2,600.
The original rumors surfaced in 2017 during Macron’s first presidential campaign but gained renewed attention in recent years as they were amplified on social media.
President Macron addressed the issue publicly in 2023, describing the rumors as “sexist” attempts to discredit a “powerful woman.”
