A panel of federal judges in New Jersey has removed U.S. Attorney Alina Habba from her post, cutting short her tenure less than four months after she assumed the role.
Habba, a former personal attorney to President Donald Trump, was appointed in March under an executive order granting her 120 days as interim U.S. attorney without Senate confirmation.
But on Tuesday, Chief Judge Renée Marie Bumb signed an order naming Desiree Leigh Grace as her replacement, effective July 22, 2025, or at the expiration of Habba’s 120-day term — whichever comes later.
The court’s action underscores the tension surrounding Habba’s appointment. U.S. attorneys require Senate confirmation, and Habba’s prospects for reaching the 51-vote threshold were uncertain from the start. Allies had hoped New Jersey’s district judges would allow her to remain in the position despite that uncertainty.
Deputy U.S. Attorney General Todd Blanche sharply criticized the court’s move, accusing the judges of political interference.
“The district court judges in NJ are trying to force out @USAttyHabba before her term expires at 11:59 p.m. Friday,” Blanche wrote on X. “Their rush reveals what this was always about: a left-wing agenda, not the rule of law. When judges act like activists, they undermine confidence in our justice system. Alina is President Trump’s choice to lead — and no partisan bench can override that.”
Habba, who became a prominent Trump defender during his 2023 and 2024 civil trials, built a reputation for directly confronting prosecutors, the FBI, and special counsel Jack Smith, often accusing them of political bias. Her loyalty to Trump, dating back to her time as his counsel in the White House and private practice, made her a clear favorite for the interim appointment.
Her nomination remains stalled before the Senate Judiciary Committee, where Chairman Chuck Grassley (R-IA) has yet to marshal sufficient support for a floor vote. She is the second Trump nominee to face roadblocks in the committee this year, after Ed Martin, the president’s choice for U.S. attorney in Washington, D.C., saw his nomination derailed.
Habba, a New Jersey native who transitioned from the fashion industry to law after earning her degree from Widener University in 2010, began representing Trump in 2019 after joining his Bedminster golf club.
