If you ever needed proof that the activist bench is alive and well in 2025, look no further than U.S. District Judge Indira Talwani’s decision to partially block President Trump’s plan to defund Planned Parenthood. The ink was barely dry on the One Big Beautiful Bill Act—a landmark budget passed by a Republican-controlled Congress and signed by President Trump—before this Obama-appointed judge swooped in to rescue the nation’s largest abortion provider.
Let’s be clear: what happened here is not “justice.” It’s judicial activism, plain and simple. Congress, with the full support of the American people who delivered a conservative wave in 2024, passed legislation to cut off taxpayer dollars flowing to a morally bankrupt organization. President Trump signed it. That’s how our system is supposed to work. But now, an unelected judge is trying to override the will of the people because she doesn’t like the result.
Talwani’s ruling claims that stripping Medicaid funds from Planned Parenthood “unconstitutionally punishes” the organization’s affiliates that don’t perform abortions. That’s a tortured interpretation, to say the least. The bill targets federal subsidies for any group affiliated with an entity that provides abortions. It’s not about punishing services that aren’t abortions—it’s about refusing to subsidize an abortion industrial complex. In other words, if you’re in bed with Big Abortion, taxpayers shouldn’t be footing your bills.
The Department of Justice made a strong argument: Planned Parenthood’s supposed harm is purely economic, and any alleged patient impact is speculative at best. “Planned Parenthood fails to demonstrate imminent irreparable harm,” DOJ attorneys wrote. Exactly right. There’s no constitutional right to government funding. Cutting off taxpayer dollars is not the same as banning services. If Planned Parenthood’s non-abortion services are so vital, let the billion-dollar organization fund them without dipping into the American taxpayer’s wallet.
Planned Parenthood’s lawsuit is a desperate act of self-preservation. According to their own filings, losing Medicaid funding could lead to the closure of roughly 200 of their 600 facilities. That’s a staggering admission. If abortion is such a small part of what they do—as they always claim—how could defunding abortion-linked subsidies jeopardize half of their operations? The truth is simple: abortion is their business model. Strip away the federal gravy train, and the empire crumbles.
And let’s not forget the broader context. This provision is a direct result of the post-Roe era—a time when the pro-life movement is finally on offense after decades of playing defense. Since the Supreme Court rightly overturned Roe v. Wade, the federal government has a moral obligation to stop subsidizing abortion providers. President Trump made that clear, and the GOP delivered. But the radical left won’t give up their sacred cow without a fight.
Judge Talwani’s order is only a partial injunction and, for now, affects Planned Parenthood facilities that don’t perform abortions or those receiving less than $800,000 in Medicaid reimbursements. But the goal is obvious: stall long enough for the courts to invent new legal theories to protect Planned Parenthood. This is a strategy of delay and distraction, not legitimate jurisprudence.
The Trump administration is expected to appeal the decision, and rightly so. Every day that goes by with our tax dollars being funneled into this corrupt organization is a day too long. And let’s not kid ourselves—Planned Parenthood is not a benevolent health care provider. It’s a political machine, a lobbyist network, and a key pillar of the Democratic Party. They use our tax dollars to fund their infrastructure, push gender ideology, and promote abortion on demand.
It’s time to end this once and for all. The One Big Beautiful Bill Act was a massive step forward, and we owe it to future generations to see it through. The fight to defund Planned Parenthood isn’t just about budgets—it’s about who we are as a nation. Do we stand for life, accountability, and respect for the rule of law? Or do we let unelected judges protect an industry built on death and deception?
