The Justice Department under President Donald Trump has firmly rejected Ghislaine Maxwell’s bid to overturn her conviction, dealing a devastating setback to the imprisoned socialite’s legal team.
Attorney General Pam Bondi’s DOJ filed a response Monday urging the Supreme Court to dismiss Maxwell’s case, effectively shutting down her attorneys’ arguments that a 2008 plea deal should have protected her from prosecution.
Maxwell, 63, currently serves a 20-year sentence for her role in Jeffrey Epstein’s child sex trafficking operation.
Her legal team contended she should never have faced trial due to Epstein’s non-prosecution agreement with Florida prosecutors.
John Sauer, Trump’s pick for Solicitor General, delivered harsh criticism of Maxwell’s attorneys, calling their legal arguments an “implausible reading” of the law and describing their case as “misplaced.”
The decision arrives as Maxwell was photographed during her daily exercise routine at FCI Tallahassee, appearing like any other inmate in standard gray prison attire during a 45-minute evening run.
She was also seen pacing in prison, per reports.
Maxwell’s attorney David Oscar Markus responded to the ruling with pointed criticism of the Trump administration.
“He’s the ultimate dealmaker – and I’m sure he’d agree that when the United States gives its word, it should keep it,” Markus stated.
The attorney added frustration over what he termed government inconsistency: “With all the talk about who’s being prosecuted and who isn’t, it’s especially unfair that Ghislaine Maxwell remains in prison based on a promise the government made and broke.”
Bondi faces mounting pressure from Trump’s base regarding her handling of the broader Epstein case.
The DOJ and FBI recently released an unsigned memo concluding that Epstein died by suicide in August 2019 and possessed no “client list” of high-profile conspirators.
The memo’s assertion that no additional arrests would follow sparked outrage among Trump supporters, with some calling for Bondi’s dismissal and Deputy FBI Director Dan Bongino threatening resignation.
Trump has publicly defended Bondi’s leadership despite growing criticism from pro-MAGA voices over her management of the Epstein files review.
The 21-page DOJ filing systematically dismantles Maxwell’s immunity claims, arguing that Epstein’s 2008 agreement covered only four specific women and explicitly excluded Maxwell from protection.
The document states the agreement “cannot reasonably be construed” to provide immunity across all federal districts, calling such interpretation “implausible” and noting lower courts reached identical conclusions.
DOJ attorneys ridiculed Maxwell’s suggestion that “United States” in the agreement referred to the entire federal government rather than Florida prosecutors specifically involved in the deal.
The filing reveals prosecutors were unaware of Maxwell’s role in Epstein’s operation when the 2008 agreement was signed, despite multiple victims reporting encounters with a British-accented woman.
The Daily Mail highlighted that Maxwell maintained a central position in Epstein’s circle during the late 1990s and 2000s, living at his Palm Beach and New York residences while frequently traveling on his private aircraft.
The document emphasizes Maxwell’s peripheral status in the original agreement: “There is no evidence that the parties to the NPA intended for the coconspirators clause to benefit petitioner (Maxwell).”
“The government was not even aware of petitioner’s role in Epstein’s scheme at that time.”
Maxwell remains the sole individual imprisoned for crimes connected to Epstein’s trafficking network following the deaths of Epstein and French modeling agent Jean-Luc Brunel, who died by suicide in 2022.

“She remains the only person to be jailed in connection to Epstein and she would welcome the chance to tell the American public the truth.”
Former Trump associate Alan Dershowitz advocates for Maxwell’s sentence commutation, telling Daily Mail her 20-year term represents excessive punishment for her alleged crimes.
