The hearing came after the Department of Justice indicted her on charges that carry a maximum eight-year prison sentence and a fine of up to $250,000.
Though the congresswoman described the charges as politically motivated and racially driven, video footage reportedly showed physical contact being initiated by McIver against federal officers. The Justice Department has denied that political factors played any role in the decision to pursue prosecution.
Acting U.S. Attorney Alina Habba, who once served as legal counsel for President Trump, emphasized that the rule of law had to be upheld, regardless of the individual involved. The charges, it was stated, stemmed from an alleged assault on federal personnel and were unrelated to any policy oversight responsibilities.
McIver, who has served New Jersey’s 10th Congressional District since September, dismissed the charges as absurd during an appearance on CNN. She claimed her presence at the detention center was part of official duties and insisted the incident had been escalated by ICE agents.
However, law enforcement officials and court records point to the seriousness of the encounter, and critics argue that the situation reflects broader issues of accountability among elected officials who appear to place themselves above the law. While Booker continues to frame such prosecutions as politically charged, legal experts have noted that no evidence has been offered so far to support claims of political targeting by the Department of Justice.
