
The United States Second Circuit Court of Appeals on Wednesday overturned the conviction of Douglass Mackey, a pro-Trump memester convicted of 2016 election interference.
“BREAKING: THE SECOND CIRCUIT COURT OF APPEALS HAS THROWN OUT MY CONVICTION FOR LACK OF EVIDENCE. THE CASE HAS BEEN REMANDED TO THE DISTRICT COURT WITH ORDERS TO IMMEDIATELY DISMISS. HALLELUJAH!” Mackey posted on X on Wednesday.
Mackey was convicted in March 2023 for posting a meme in 2016 that encouraged supporters of then-Democratic presidential candidate Hillary Clinton to cast their vote by text. The offending image included a picture of a woman with a pro-Clinton sign and bore the message “Avoid the Line. Vote from Home. Text ‘Hillary’ to 59925[.] Vote for Hillary and be a part of history.”
He was sentenced to seven months in prison in October 2023, though the 2nd Circuit Court of Appeals stayed the sentence, pending his appeal.
On Wednesday, the court wrote in its decision that Mackey argued “that the evidence was insufficient to prove that he knowingly agreed to join the charged conspiracy. We agree. Accordingly, we REVERSE Mackey’s conviction and REMAND the case to the district court with instructions to enter a judgment of acquittal.”
