On Monday, three days after President Trump signed the One Big Beautiful Bill Act into law defunding America’s biggest abortion business, Planned Parenthood filed a lawsuit challenging the defunding provision in federal district court in Massachusetts.
Congress enacted a one-year defund on big abortion businesses like Planned Parenthood, which received $2 million per day to fund its abortion enterprise.
As LifeNews reported, U.S. District Judge Indira Talwani, an Obama appointee, issued the temporary nationwide restraining order days after the Supreme Court issued a ruling putting limits on the nationwide injunctions that rouge liberal judges can issue.
But now the White House is fighting back.
In response to the ruling, a White House official said, “The Trump Administration is ending the forced use of Federal taxpayer dollars to fund or promote elective abortion – a commonsense position that the overwhelming majority of Americans agree with.”

The Trump administration is planning a legal response and appeal of the decision, especially in light of how it violates the recent Supreme Court ruling limiting the power of federal judges to issue nationwide injunctions. Meanwhile, the nation’s highest court ruled that states like South Carolina have the ability to defund Planned Parenthood.
Still, Planned Parenthood complains defunding will cripple its abortion business.
“Many Planned Parenthood Members will be required to lay off staff and curtail services, with serious adverse consequences for the many patients served at those centers even if they do not use Medicaid to access services. Worse still, Members may be forced to shutter a substantial number of their health centers nationwide, many of which are in rural or underserved areas without alternative providers,” the lawsuit read.
Susan B. Anthony Pro-Life America, criticized the lawsuit and argued Trump’s domestic policy bill cut off funding to the “abortion industry.”
“Planned Parenthood’s desperation is showing as they run to the courts again to fix a crisis of their own making,” the group’s director of legal affairs and policy counsel, Katie Daniel, said in a statement Monday.
She added:
Planned Parenthood makes two arguments: first, that the defunding provision is a “bill of attainder” because it singles out PPFA for punishment, and second, that the defunding provision punishes PPFA’s speech and association, in violation of the first amendment.
Both are debunked well by NRO’s Dan McLaughlin HERE: “At bottom, this lawsuit is grounded in the notion that Planned Parenthood and the cause of abortion are immune from the usual forces of law, and of democracy (the Planned Parenthood brief cites a dozen cases with its own name in the caption but doesn’t even cite the leading Supreme Court case on legislative retaliation), but the Supreme Court just rejected that in a case involving states defunding the nation’s largest abortion provider from Medicaid.”
A leading pro-life group condemned Planned Parenthood’s desperate lawsuit to get around Congressional defunding.
National Right to Life today condemned Planned Parenthood’s decision to sue the Trump administration over the newly enacted “One Big Beautiful Bill,” which strips the abortion industry of taxpayer funding for one year.
“Planned Parenthood’s priority is abortion—not women’s health, not compassion, and certainly not life,” said Carol Tobias, president of National Right to Life. “This lawsuit is a desperate attempt to maintain their grip on public dollars. But the American people are watching—and they deserve better than being forced to fund abortion providers.”
The One Big Beautiful Bill, signed into law on July 4th by President Donald J. Trump, includes critical provisions that halt the use of taxpayer dollars to subsidize the abortion industry. It passed narrowly in Congress after a strong show of resolve from pro-life lawmakers.
“President Trump and pro-life leaders in Congress delivered a major victory for unborn children, their mothers, and for taxpayers,” Tobias continued. “It’s shameful—but not surprising—that Planned Parenthood is turning to the courts to overturn the will of the people and protect their multimillion-dollar abortion enterprise.”
National Right to Life applauds the administration for standing firm in the face of legal threats and urges the courts to uphold the law as a legitimate exercise of Congressional authority.
Pro-life leaders hailed the signing as a historic step toward protecting unborn lives, calling it a sweeping legislative victory that marks a turning point for pro-life policy in America.“President Trump has once again delivered on his promise to protect the most vulnerable among us,” said Carol Tobias, president of National Right to Life. “With his signature on the ‘One Big Beautiful Bill,’ the flow of taxpayer dollars into the multibillion-dollar abortion industry will be halted for one year.”
The legislation passed narrowly in Congress, demonstrating the strength and resolve of pro-life leadership in the House and Senate. National Right to Life commended House Speaker Mike Johnson, Senate Majority Leader John Thune, and the pro-life members of Congress who stood firm in their commitment to defend life.
“This law is a historic step forward in fostering a culture that protects women and cherishes unborn children,” said Tobias. “It sends a clear message: We can, and must, support both mother and child. President Trump’s leadership made that vision a reality.”
The bill, known as H.R. 1, marks a significant step in the pro-life movement’s long-standing effort to end federal funding for Planned Parenthood, a radical organization that kills over 400,000 babies in abortions annually while receiving more than $700 million in government funds.
The defunding provision, outlined in Section 44126 of the bill, effectively terminates Medicaid reimbursements to Planned Parenthood, closing a loophole that has allowed the organization to access federal funds despite the Hyde Amendment’s ban on direct taxpayer funding for abortions. Pro-life leaders hailed the move as a fulfillment of decades-long promises to prioritize women’s health without supporting abortion.
According to Planned Parenthood’s latest annual report, the organization killed more than babies in 400,000 abortions in 2023 and 2024 and received nearly $800 million from taxpayers.
The Hyde Amendment already prohibits federal funds from directly paying for abortions. However, Planned Parenthood receives approximately $700 million annually through Medicaid reimbursements and Title X grants. Pro-life leaders argue this funding frees up resources for Planned Parenthood’s abortion operations.
