Border Czar Tom Homan has confirmed that Rep. Alexandria Ocasio-Cortez (D-NY) is under federal investigation for allegedly employing an illegal immigrant and assisting others in evading Immigration and Customs Enforcement operations.
During an interview with political commentator Benny Johnson, Homan disclosed that ICE has been directed to examine the case involving the New York Democrat.
The investigation centers on allegations that Ocasio-Cortez employed an undocumented individual in her congressional office.
“It’s being looked at, can’t comment past that. I’m aware of it, we’ve asked ICE to drill in on that case,” Homan stated during the interview.
He emphasized that the ongoing investigation prevents him from providing additional details about the matter.
The border czar also addressed Ocasio-Cortez’s efforts to educate constituents about their rights when encountering ICE agents.
Homan characterized these educational sessions as potentially criminal instruction rather than legitimate civic guidance.
“As far as you know her educating people on how to evade ICE arrests, she’s really educating them on how to be prosecuted…when you knowingly hinder your removal, that’s a crime,” Homan explained to Johnson.
When questioned about the possibility of employing an illegal immigrant within Congress, Homan stated definitively that “it is not possible.”
The investigation appears connected to Diego de la Vega, who served as deputy communications director for Ocasio-Cortez.
De la Vega relocated to Colombia in March after spending 23 years in New York City following his arrival as a child, according to Washington Examiner reporting.
Born in Ecuador, de la Vega entered the United States at age seven on a visitor’s visa.
He subsequently overstayed that visa, rendering him undocumented throughout his adult life in America.
The Examiner highlighted that while speaking to Migrant Insider, de la Vega described his departure from the United States as bittersweet.
“I hadn’t left the country in 23 years—from age seven to age thirty. Now, I can’t go back to the U.S,” he said.
“It feels like exile. It’s a very permanent move. But my wife and I are confident we made the right decision. And after some time, it’s been a real pleasure to be here.”
De la Vega expressed relief at no longer living as an undocumented person.
“It feels surreal to not be ‘illegalized’ anymore. I don’t have to live in the shadows or constantly worry about paperwork,” he said.
“That freedom of movement is incredibly satisfying. I might not be able to return to the United States for many years—I don’t know how long. But it feels fulfilling to be home.”
Prior to joining Ocasio-Cortez’s office in 2022, de la Vega maintained an active political career.
He previously served as a congressional fellow for former Rep. Carolyn Maloney (D-NY), according to his LinkedIn profile.
Ocasio-Cortez defended her former staffer when approached by Migrant Insider in the Capitol building.
“Diego is amazing” and “We love him,” she stated when asked about de la Vega.
The investigation follows Homan’s criticism of Ocasio-Cortez’s “Know Your Rights” webinar, which she hosted in February for constituents.
The educational session focused on proper procedures for interacting with ICE agents during enforcement operations, Resist the Mainstream previously reported.
Following Homan’s public statements, Ocasio-Cortez wrote to Attorney General Pam Bondi requesting clarification about potential Department of Justice involvement.
Her February letter sought confirmation about whether the DOJ was investigating her activities.
“I write to request clarity on whether the Department of Justice (DOJ) has yielded to political pressure and attempts to weaponize the agency against elected officials whose speech they disagree with,” she wrote.
“Over the past two weeks, ‘Border Czar’ Tom Homan has gone on multiple forums threatening political prosecution against me, citing resources I distributed informing my constituents and the American public of their constitutional and legal rights.”
Ocasio-Cortez characterized Homan’s statements as intimidation tactics against elected officials.
She argued that his “attempts to use your agency to politically intimidate duly elected officials are a textbook threat to the right to free speech in the United States.”
During a May town hall event in Queens, Ocasio-Cortez demonstrated defiance regarding the investigation.
“Come for me,” she declared to attendees, indicating she would not be deterred by the federal scrutiny.
