Senator Rand Paul is preparing to subpoena Dr. Anthony Fauci as part of an intensifying investigation into what he calls a massive COVID-19 cover-up tied to federal funding of gain-of-function research. Paul, who chairs the Senate Committee on Homeland Security and Governmental Affairs, announced the effort Monday, declaring the American public deserves full transparency regarding the origins of COVID-19.

Paul revealed that he is coordinating with former FBI official Kash Patel to investigate Fauci’s role in approving high-risk research and potentially misleading Congress. Central to the probe is Fauci’s alleged involvement in the funding and oversight of viral enhancement experiments at the Wuhan Institute of Virology.
Gain-of-function research involves manipulating viruses to increase their transmissibility or lethality. Critics argue that such work may have directly contributed to the emergence of SARS-CoV-2. Dormant concerns erupted again after a recent release of Fauci’s 2020 schedule revealed meetings with Ralph Baric, a key figure in viral engineering and seamless ligation techniques—methods some say are used to conceal human manipulation of pathogens.
The COVID-19 cover-up inquiry is part of a broader investigation that began in 2023, when Paul subpoenaed over a dozen agencies, including the FBI, CIA, NIH, and HHS, for documents related to COVID’s origins and federal research funding. In May, Paul warned Fauci would be compelled to testify “voluntarily or involuntarily.”
This is not Paul’s first legal pursuit of Fauci. He submitted criminal referrals in 2021 and 2023, accusing Fauci of perjury—a charge that can carry a five-year prison term. Rutgers molecular biologist Dr. Richard Ebright echoed Paul’s criticisms, stating Fauci violated multiple federal policies and “caused a pandemic that killed over 20 million and cost $25 trillion.”
RFK Jr. also weighed in Monday, telling Tucker Carlson that a “truth commission” could serve as an alternative to legal prosecution—granting immunity to those who testify truthfully and exposing those who don’t. Kennedy claimed President Biden issued a preemptive pardon for Fauci in the final moments of his presidency, shielding him from federal prosecution for actions dating back to 2014. Legal experts, however, say this pardon would not prevent Fauci from facing perjury charges or civil suits.
Despite the pardon, Fauci is still vulnerable. Attorney Rick Jaffe explained that “Fauci can still be subpoenaed to testify before Congress,” and could be prosecuted if he lies under oath—especially about the COVID-19 cover-up or concealed communications with reporters using private email accounts.
In January 2024, Fauci testified before the House and stated over 100 times that he could not recall key events related to the pandemic response. Paul later remarked that NIH, Fauci’s former agency, was “more secretive than the CIA.”
The lab-leak theory has gained support across government bodies, including the CIA, FBI, and U.S. Department of Energy, all of whom acknowledge that a Wuhan lab escape is a plausible explanation. The Trump administration’s relaunch of the COVID-19 website in April further endorsed the lab-leak theory.
In response to these revelations, President Trump signed an executive order banning U.S. funding of dangerous gain-of-function research overseas and placed a 120-day moratorium on such research within the U.S. Meanwhile, NIH shut down a research center founded by Fauci and suspended active gain-of-function grants. The USDA followed suit by rejecting all new proposals related to viral enhancement as of June 20.
Senator Paul introduced legislation to cement these changes permanently: the Risky Research Review Act, which would establish independent oversight for gain-of-function projects, and the NIH Reform Act, aimed at increasing congressional oversight of Fauci’s former agency, NIAID.
Paul insists the probe isn’t about political revenge. “You don’t need to believe COVID-19 came from a lab to recognize the danger of unregulated viral manipulation,” he wrote. “The mere possibility of a lab leak should have triggered serious safeguards years ago.”
