In a 6-3 decision, the U.S. Supreme Court issued a pivotal birthright citizenship ruling that stops short of addressing the constitutional merits of the president’s executive order. Instead, the Court ruled that federal district judges cannot issue nationwide injunctions in such cases, restricting their authority to the regions where they preside.
While the birthright citizenship ruling does not determine whether the president’s executive order ending automatic citizenship for children born to non-citizens is constitutional, it allows the administration to begin enforcing the policy in states where the order has not yet been legally blocked.
Attorney General Pam Bondi clarified the scope of the decision: “If there’s a birthright citizenship case in Oregon, it will only affect the plaintiff in Oregon, not the entire country.” She emphasized that the Supreme Court will review the executive order’s constitutional legitimacy in its next term, beginning in October.
The administration, confident in its position, believes the Court will ultimately side with its interpretation of the 14th Amendment. Until then, the question of who will handle the vetting of newborns’ citizenship status remains unresolved.
President Trump hailed the decision as “a tremendous win,” accusing past administrations of misinterpreting birthright citizenship and alleging that drug cartels had exploited the policy to bring “very bad people” into the country.
The ruling includes a 30-day grace period before enforcement begins, during which the Trump administration has committed to abiding by the law. “We’re gonna do what’s right in the bounds of the law,” Bondi said.
This birthright citizenship ruling may only be procedural for now, but it sets the stage for a historic Supreme Court confrontation in the next term—one with major implications for immigration, federal authority, and the meaning of the 14th Amendment.
