Former Supreme Court Justice Anthony Kennedy warned that criticism of judges puts democracy at risk in remarks during an appearance at a virtual forum for the group Speak Up for Justice on Thursday.
The Ronald Reagan appointee, who retired in 2018, suggested that angry rhetoric and threats to judges are threatening the traditional role of the United States as a shining example of democracy to other countries, remarks delivered as the Supreme Court prepares to wrap up its current term on Friday with several consequential rulings yet to be announced.
“Many in the rest of the world look to the United States to see what democracy is, to see what democracy ought to be,” he said, according to Politico. “If they see a hostile, fractious discourse, if they see a discourse that uses identity politics rather than to talk about issues, democracy is at risk. Freedom is at risk.”
“We should be concerned in this country about, as I’ve already indicated, the tone of our political discourse,” Kennedy said. “Identity politics are used so that a person is characterized by his or her partisan affiliation. That’s not what democracy and civil discourse is about.”
The grave warning was delivered at a time when activists on the federal bench have taken it upon themselves to subvert the results of the 2024 election by firing off a flotilla of temporary restraining orders and national injunctions that have prevented President Donald J. Trump from carrying out his mandate for reform after his overwhelming election victory, sweeping the swing states and winning the popular vote as well.
So much for democracy.
While not specifically mentioning Trump, there can be little doubt that was who he was at least partially referring to.
Trump has slammed rogue judges who have become the front lines of the resistance in his second term. In March, the president blasted DC District Court Judge James Boasberg as a “radical left lunatic of a judge, a troublemaker and agitator” and called for him to be impeached after the Obama appointee moved to block the deportation of dangerous illegal alien thugs under the Alien Enemies Act of 1798.
In a Memorial Day Truth Social blast, Trump said that the left-wing judges “are on a mission to keep murderers, drug dealers, rapists, gang members, and released prisoners from all over the world, in our country so they can rob, murder, and rape again,” branding the “USA hating judges” as “monsters who want our country to go to hell.”
Also taking a veiled shot at Trump during the Speak Up for Justice event was U.S. District Judge Esther Salas, whose son was murdered by a disgruntled attorney posing as a delivery driver at her home in New Jersey in 2020, saying that disinformation was being spread about judges “from the top down.”
“Judges are rogue. Sound familiar? Judges are corrupt. Sound familiar? Judges are monsters. … Judges hate America,” the Obama appointee said. “We are seeing the spreading of disinformation coming from the top down.”
“For more than four decades, Justice Kennedy served our nation with incredible passion and devotion. I’d like to thank Justice Kennedy for a lifetime of distinguished service,” Trump said of Kennedy in July 2018 after he announced his retirement.
