The winds of change are blowing out of California – and for once, it’s not the Santa Ana winds, but a legal shift with national impact. The Ninth Circuit Court of Appeals—historically known for being one of the most notoriously liberal appellate courts in the country—issued a decisive ruling on June 19th, 2025, that vindicates President Donald J. Trump’s federalization of the National Guard. In response to growing unrest in Los Angeles tied to immigration enforcement, President Trump, well within his constitutional authority, called 4,000 National Guard troops into federal service under 10 U.S.C. § 12406. California Governor Gavin Newsom sued, claiming the order violates the Tenth Amendment and oversteps executive authority.
A lower court initially sided with Newsom, blocking the deployment and demanding that control of the California National Guard be returned to Newsom. However, the Ninth Circuit granted a stay, effectively overturning that decision. The court found that the President lawfully invoked § 12406(3), which allows federalization of the National Guard when regular forces are insufficient to execute federal law. The court also rejected California’s claim that deploying the National Guard would escalate tensions, calling those fears “too speculative.” Citing a 2024 Supreme Court decision, Murthy v. Missouri, the Ninth Circuit made it clear that imagined consequences do not justify defiance of federal authority. All stay factors favored President Trump, so the Ninth Circuit granted the stay pending appeal.
This isn’t the first time a president has had to federalize the National Guard. In 1965, President Lyndon B. Johnson federalized Alabama’s National Guard to protect civil rights marchers, including Dr. Martin Luther King Jr., during the Selma-to-Montgomery march. Johnson acted only after Alabama Governor George Wallace refused to protect peaceful demonstrators. Then, and now, federal intervention becomes necessary when state leaders abandon their constitutional responsibilities to protect law-abiding citizens.
In perfect harmony with the radical left, CNN falsely claimed that less than 10% of immigrants taken into ICE custody since October had serious criminal convictions. However, the Department of Homeland Security set the record straight: 75% of illegal aliens arrested by ICE have criminal convictions or pending charges. These are not harmless migrants—those being arrested and deported are criminals shielded by politicians like Karen Bass and Gavin Newsom at the expense of law-abiding citizens.
Gavin Newsom is the worst offender of political grandstanding and a blatant disregard for the health, safety, and welfare of California citizens. In an already financially insolvent state, he continues to pour millions of taxpayer dollars into political stunts. Newsom recently approved $50 million in public funds to finance legal battles against the Trump administration—money that could go to crime victims, fire victims, veterans, and/or homeless families, but instead goes to sue the federal government in a desperate bid to score political points. This follows a special legislative session he called specifically to prepare for Trump’s presidency, revealing just how deeply partisan his actions are.
The winds are shifting, and the law is on the side of order. President Donald Trump’s vision of a sovereign, secure, and lawful America is once again leading the way. As the country awaits the full trial on the merits of the case, Newsom’s legal team must meet a higher standard than before, showing that their case is likely to succeed at trial—a key requirement for securing a preliminary injunction.
It would be in the best interests of California citizens if Gavin Newsom would quit wasting taxpayer time and money on waging wars against President Trump and start working on behalf of the millions of Californians who need effective change and leadership. The message should be clear to the 11 states and approximately 600 sanctuary jurisdictions that have declared themselves “sanctuary states/cities” in the United States – law and order is on the side of U.S. citizens.
