A federal judge ruled Monday that the Trump administration DEI grant termination ruling invalidates the decision to cancel federal health grants tied to “gender ideology” and “diversity, equity, and inclusion” (DEI). The grants, funded through the National Institutes of Health (NIH), were previously withdrawn earlier this year in a move that several public health and civil liberties groups immediately challenged in court.
U.S. District Judge William Young, a Reagan appointee, determined that the administration’s move to halt NIH funding for research involving LGBTQ issues, gender identity, and DEI lacked legal justification. According to Young, targeting such programs based on their ideological framing constituted arbitrary and unlawful action. The ruling mandates that federal funding be reinstated to affected recipients immediately.
Several plaintiffs, including the American Public Health Association (APHA), Ibis Reproductive Health, and the American Civil Liberties Union, celebrated the decision. “The ideologically motivated directives to terminate grants alleged to constitute DEI, ‘gender ideology,’ or other forbidden topics were, in fact, arbitrary and capricious,” said Peter G. Lurie, president of the Center for Science in the Public Interest.
Despite the Trump administration DEI grant termination ruling, the Department of Health and Human Services (HHS) remains firm in its position. An HHS spokesperson emphasized the agency’s belief that programs should be grounded in “evidence-based practices and gold standard science,” rather than “divisive DEI mandates.” The administration is expected to appeal or seek a stay on the ruling.
APHA Executive Director Georges Benjamin expressed concern that the administration might attempt to delay implementation despite the legal order. “Spigots have been turned back on,” he said, “but this administration has tried to find ways to slow things down… They’ve been pretty sneaky about trying to find ways to get around judges’ rules.”
