A federal judge rejected California Governor Gavin Newsom’s emergency petition to immediately halt President Donald Trump’s deployment of military forces in Los Angeles.
U.S. District Judge Charles Breyer denied Newsom’s request for an immediate restraining order on Tuesday, delivering a setback to the governor’s legal challenge against federal military presence in the state.
The ruling came after California Attorney General Rob Bonta initiated legal action on Monday to prevent the deployment of National Guard troops and U.S. Marines in the region.
Newsom escalated the legal battle by filing an emergency motion seeking swift judicial intervention to stop the military deployment.
The governor’s legal filing contained testimony from Paul Eck, deputy general counsel in the California Military Department, who outlined federal plans to utilize military personnel for immigration enforcement support.
Military forces would establish secure perimeters around locations where immigration operations occur and provide street security for federal agents conducting their duties, according to the declaration.
Federal immigration agents faced violent attacks during legitimate enforcement operations in Los Angeles over the weekend, with Friday and Saturday witnessing particularly aggressive confrontations.
Similar incidents of resistance to federal immigration enforcement have occurred in other regions across the country, though these encounters were less severe than those witnessed in Los Angeles.
Military personnel have maintained their focus on protecting federal facilities, though their operational scope remains subject to potential expansion.
Judge Breyer granted the Trump administration additional time to formulate their response to California’s legal challenge, extending the deadline until 2 p.m. Eastern Time on Wednesday.
Newsom’s emergency request specifically targeted military involvement in immigration enforcement rather than their protective duties at federal properties, claiming such deployment would cause “irreparable harm to our communities and the rule of law.”
The Trump administration dismissed Newsom’s legal challenge as “legally meritless” in their official opposition filing, per Trending Politics.
Newsom’s court documents accused the federal government of introducing a “warrior culture” to American communities where families live and work.
“Defendants, including President Trump and Secretary of Defense Hegseth have sought to bring military personnel and a ‘warrior culture’ to the streets of cities and towns where Americans work, go to school, and raise their families,” the filing stated.
“Now, they have turned their sights on California with devastating consequences, setting a roadmap to follow across the country.”
The legal battle unfolds as Los Angeles prepares for a potential fifth consecutive night of civil unrest following days of escalating violence that have tested local law enforcement capabilities.
National Guard forces provided crucial assistance to Los Angeles Police Department officers during riot control operations on Monday evening, marking their first deployment for such purposes since the current wave of unrest began.
The collaboration between military personnel and local police represents a significant escalation in the federal response to the ongoing civil disorder plaguing the nation’s second-largest city.
After law enforcement successfully dispersed crowds from the federal building near city hall, rioters fragmented into smaller groups and began targeting businesses in Little Tokyo and surrounding downtown areas.
President Trump indicated his willingness to invoke the Insurrection Act if the violence continues, speaking to reporters from the Oval Office on Tuesday during a discussion about federal response options.
“If there’s an insurrection, I would certainly invoke it. We’ll see,” Trump declared.
“But I can tell you last night was terrible, and the night before that was terrible.”
