A murder suspect was mistakenly released from Cuyahoga County Jail over a typo.
Court documents from the Cuyahoga County Court of Common Pleas indicated that Amarion Sanders, 22, was released due to a “typographical error” on Monday.
The court told 3News that it expressed regret over the incident.
It attributed Sanders’s release to a rare occurrence where two criminal cases with consecutive numbers were mistakenly assigned to the same judge during arraignment.
“The Court cannot discuss an open case, but we deeply regret the error,” a statement from the court read.
“In this instance, criminal cases with consecutive numbers (CR-23-685908 and CR-23-685909) were randomly assigned to the same Judge at arraignment, which is rare with 34 Judges on the bench.”
“Had the cases been on different dockets, the system would have flagged the error when it was entered.”
“The Court will review our procedures and work with the Sheriff’s Department to determine how best to ensure that a similar incident does not happen in the future.”
“We are grateful for the assistance of law enforcement in providing the safe return of Mr. Sanders,” it continued.
Sanders was being held on a $1 million bond, per Cleveland.com.
He was apprehended again on Wednesday and is now back in custody, per a spokesperson for Cuyahoga County.
The murder suspect was taken into custody by members of the U.S. Marshals Task Force at approximately 9:30 am.
He will be transported to the Cuyahoga County Corrections Center for booking and housing.
Sanders faces serious charges including aggravated murder, two counts of murder and two counts of felonious assault in connection with the death of Derrick Driskill.
Sanders is slated to stand trial beginning August 19, following several pretrial hearings.
Driskill’s wife Andrea Johnson expressed her shock over the ordeal in a statement to Fox 8.
“Obviously I was heartbroken,” she said of her husband’s death. “I didn’t want to believe it, but I thought he would be OK, but he died two days later.”
Upon learning that Sanders was “inadvertently dismissed” over the court error, Johnson said, “I don’t think it’s fair.”
”I mean, that’s not justice, it’s not our family feeling safe. I mean, he’s out on the street and can do it to somebody else.”
“I honestly do not understand how that happens. I understand humans make mistakes, but you would think there’s more than one person that something like that goes through.”
Investigators said Driskill was killed on September 23, 2023, during a fender bender in the parking lot of a carryout on Cleveland’s east side.
The incident led to the murder of the 39-year-old married father of three, after a car ran into the back of Driskill’s new Mercedes Benz.
A passenger eventually argued with Driskill and shot him in the head before fleeing, Fox reported.
