Manhattan District Attorney Alvin Bragg found out his criminal conviction of Donald Trump was just the start of the fight.
Bragg learned some very bad news.
And Alvin Bragg got hit with a nasty Supreme Court surprise.
Bragg’s constitutionally rickety indictment of Donald Trump was never going to survive an appeals process.
To indict Trump, Bragg invented a brand-new legal theory to try Trump in front of a Democrat judge and jury on phantom crimes.
But that didn’t matter to Bragg or his fellow Democrats.
The point was that since this was a state prosecution it would take at least a year to wind its way through the New York Court of Appeals and a decision wouldn’t come down until long after the election.
Bragg and the Democrats believed by that point the conviction already would have poisoned the minds of voters against Trump leading to a Biden re-election.
The Supreme Court only has original jurisdiction – meaning it can be the first court to hear a case – in disputes between government officials or states.
That means there would be no path for Trump to have the Court hear his appeal of his conviction before the election.
Enter Missouri Republican Attorney General Andrew Bailey.
Bailey announced he will sue the State of New York for waging unconstitutional lawfare against Donald Trump to deprive the people of Missouri of their civil right to a free and fair election.
“I will be filing suit against the State of New York for their direct attack on our democratic process through unconstitutional lawfare against President Trump,” Bailey wrote on X.
“It’s time to restore the rule of law,” Bailey added.
Bailey slammed Bragg as a “rogue prosecutor” lawlessly meddling in the 2024 election.
“We have to fight back against a rogue prosecutor who is trying to take a presidential candidate off the campaign trail,” Bailey continued.
“Radical progressives in New York are trying to rig the 2024 election. We have to stand up and fight back,” Bailey added in a statement to Fox News Digital.
In his testimony before Congress, Bailey previewed the case which will be known as Missouri v. New York.
Bailey plans to sue Bragg for depriving Trump of his Sixth Amendment right by not identifying the secondary crime Bragg claimed Trump falsified business records to conceal.
The Constitution requires the government to inform a defendant of the charges against them so they can prepare a legal defense.
Bragg also failed to correct Joe Biden campaign donor and trial Judge Juan Merchan from incorrectly telling the jury they didn’t have to arrive at a unanimous verdict on what second crime Trump intended to commit or conceal by falsifying business records.
Bailey also plans to sue Bragg over Bragg targeting Trump for political reasons and scouring through the law books to manipulate statutes to fabricate crimes against Trump.
By suing New York directly Bailey hopes he can force a case before the Supreme Court to get Trump’s conviction overturned before the election.
