House Republicans have formally referred Hunter and James Biden to the Justice Department for criminal prosecution, accusing them of lying under oath during testimony as part of the impeachment inquiry into President Joe Biden. The referral, led by House Oversight Committee Chairman James Comer (R-Ky.), Judiciary Committee Chairman Jim Jordan (R-Ohio), and House Ways and Means Committee Chairman Jason Smith (R-Mo.), alleges that the Bidens made materially false statements regarding their roles in the family’s foreign influence-peddling schemes and President Biden’s knowledge and involvement in these activities.
“We’ve caught President Biden’s son and brother making blatant lies to Congress in what appears to be a concerted effort to hide Joe Biden’s involvement in his family’s schemes,” Comer stated. “This is not the end of our efforts to hold the Bidens accountable; it’s only the beginning.”
“Hunter Biden and James Biden made materially false statements to the Oversight Committee and the Judiciary Committee, as demonstrated by the evidence presented in the attached referral. The nature of these false statements is not lost on the Committees: every instance implicates Joe Biden’s knowledge of and role in his family’s influence peddling,” the lawmakers wrote in the referral obtained by National Review.
The move follows the release of documents from IRS whistleblowers Gary Shapley and Joseph Ziegler by the Ways and Means Committee in late May, which appear to contradict significant aspects of Hunter Biden’s congressional testimony earlier this year. According to these documents, Hunter Biden held an official role at Rosemont Seneca Bohai, a corporate entity he co-founded to receive payments from Ukrainian energy firm Burisma Holdings. Hunter Biden, however, testified that he had no knowledge of the Rosemont Seneca Bohai account.
National Review reports that among the evidence is a text message Hunter Biden sent to an executive of the Chinese conglomerate CEFC in July 2017, threatening to use his father’s influence if he did not receive payment. Hunter indicated that he was “sitting next to my father” while sending the text, implying Joe Biden’s involvement. Hunter later claimed he was intoxicated and that the message was sent to the wrong person. Data from Hunter’s cell phone, provided by the IRS whistleblowers, contradicts his testimony, showing the message was correctly sent to the intended recipient.
Following the threatening text, Hunter and James Biden launched the Hudson West III joint venture with CEFC, reportedly making millions from the project, as evidenced by bank records and Hunter Biden’s federal tax indictment.
The referral also accuses Jim Biden of perjury, citing his testimony that he had never attended a meeting with former business partner Tony Bobulinski. Bobulinski testified about a meeting he had with Joe Biden, Hunter Biden, Jim Biden, and a Chinese business associate in May 2017, contradicting Jim Biden’s claims. Hunter Biden confirmed Bobulinski’s account, corroborating the latter’s testimony.
House Republicans argue that these false statements were attempts to obscure Joe Biden’s involvement in the family’s business dealings. “The House of Representatives will not countenance the use of federal funds to indoctrinate students into hateful, antisemitic, anti-American supporters of terrorism,” they stated.
The criminal referral is part of a broader investigation into the Biden family’s foreign business dealings, which have been a focal point of the House GOP’s impeachment inquiry. To date, Republicans have uncovered over $24 million sent from foreign sources to the Biden family and their business associates.
