The judge in Donald Trump’s classified documents case shut down an attempt by prosecutor Jack Smith to place a gag order on Trump after he claimed the Justice Department authorized his assassination.
Judge Aileen Cannon blasted Smith for failing to demonstrate basic “professional courtesy” with his late Friday ambush to silence Trump, who is Biden’s primary political rival in the upcoming election.
Judge rebukes Biden regime
The defense complained about the timing of Smith’s motion, which was filed at 5:30 p.m. ahead of the Memorial Day weekend. Trump’s team called Smith’s move evidence of “bad faith” and asked Cannon to censure the prosecutor.
While she didn’t go that far, she left the door open to sanctioning Smith in the future. She rejected the gag order over his failure to follow the rules, which require parties to confer before filing motions. The judge rejected Smith’s motion without prejudice, so he can try again.
“It should go without saying that meaningful conferral is not a perfunctory exercise,” Cannon wrote. “Sufficient time needs to be afforded to permit reasonable evaluation of the requested relief by opposing counsel and to allow for adequate follow-up discussion.”
Smith complained that Trump made “intentionally false and inflammatory” claims about “standard” language permitting the use of deadly force in some circumstances that was included in the search warrant for the FBI raid of Mar-A-Lago.
Without providing any evidence, Smith claimed that Trump’s assassination claims “pose a significant, imminent, and foreseeable danger to law enforcement agents.”
Unconstitutional censorship
Trump’s lawyers blasted Smith’s gag order demand as “an extraordinary, unprecedented, and unconstitutional censorship application” that “unjustly targets President Trump’s campaign speech while he is the leading candidate for the presidency.”
Adding insult to injury, Smith’s lawyers did not make an effort to confer with the defense beyond sending e-mails. The defense asked to confer on Monday, but prosecutors rejected the request, citing an urgent need to silence Trump.
“As recently as this afternoon, Mr. Trump reposted a statement on Truth Social again making the false accusations and adding new ones. Further conferral will be a fruitless exercise and does nothing to mitigate the danger your client is creating,” prosecutor Jay Bratt wrote.
Liberal pundits and Democrats have regularly attacked Cannon for refusing to rubber stamp Smith’s demands. Her latest ruling is certain to be cited by some as evidence of favoritism toward Trump, who appointed her to the bench.
Cannon postponed the trial indefinitely earlier this month, citing unresolved pre-trial issues.
