Jack Smith tries to put another unconstitutional gag order on Donald Trump
The criminal case against former President Donald Trump for allegedly mishandling classified documents isn’t going well for Special Counsel Jack Smith.
Trump is fighting the prosecution in the courtroom and the court of public opinion.
The goal of the politically motivated case is to inflict the maximum amount of damage possible on the former President before the 2024 Election.
That’s why Smith and other Democrat prosecutors have tried to silence Trump from defending himself in public with unconstitutional gag orders.
A court filing in that case revealed that the FBI was authorized to use deadly force during the surprise August 2022 raid on Mar-a-Lago.
The FBI created a potential powder keg with an unannounced raid that lasted 10 hours where they were authorized to use deadly force while ransacking Trump’s estate.
Trump fired back at the Biden administration in an email after the news about the deadly force authorization broke.
“It’s just been revealed that Biden’s DOJ was authorized to use DEADLY FORCE for their DESPICABLE raid in Mar-a-Lago. You know they’re just itching to do the unthinkable. Joe Biden was locked & loaded ready to take me out & put my family in danger,” Trump’s email stated.
That sent Democrats into a frenzy and led Smith to demand another gag order on Trump.
Judge rejects Jack Smith’s attempt to put a gag order on Donald Trump
Smith’s office filed a request with District Judge Aileen Cannon to prevent Trump from making public statements that “pose a significant, imminent, and foreseeable danger to law enforcement agents participating in the investigation and prosecution of this case.”
Prosecutors pointed to Trump’s email to claim that he was putting the FBI in danger.
They alleged that the former President’s “deceptive and inflammatory claims” would “undermine the integrity of the proceedings as well as jeopardize the safety of law enforcement.”
Smith is used to working with a friendly judge who was appointed by former President Barack Obama in the January 6 case in Washington, D.C.
Judge Cannon smacked down the prosecution’s request for another gag order on Trump.
She admonished Smith’s office for lacking “professional courtesy” and for filing a motion that lacked “substance.”
The judge pointed out that prosecutors didn’t give Trump’s legal team “sufficient time” to respond after requesting the gag order on the Friday of Memorial Day weekend.
“Because the filing of the Special Counsel’s motion did not adhere to these basic requirements, it is due to be denied without prejudice,” Judge Cannon ruled.
Trump’s legal team asked the judge to fine and sanction the prosecutors from Smith’s office.
The classified documents case is currently on pause while the court works through pretrial motions.
