Obama-appointed federal judge blocks Florida law preventing illegal aliens from registering voters
Florida Governor Ron DeSantis has made improving election integrity in the Sunshine State one of his top priorities.
He signed into law a bill that barred illegal aliens and other non-American citizens from participating in voter registration efforts for third-party groups in 2023.
Groups that violate the law can receive a fine of up to $50,000.
Democrats use third-party groups to register voters en masse in areas that are friendly to them like dense urban neighborhoods and college campuses.
Activist groups including the League of Women Voters, NAACP, Hispanic Federation, and Poder Latinx filed a lawsuit against Florida to overturn the ban on illegal aliens registering voters.
The lawsuit claimed that the employment opportunities of two non-American citizens, Veronica Herrera-Lucha and Norka Martínezas, as paid canvassers for voter registration as drives were harmed.
U.S. District Chief Judge Mark Walker, who was appointed by former President Barack Obama, ruled that the law was unconstitutional because it discriminated against illegal aliens because of their citizenship status.
Walker ordered Florida Secretary of State Cord Byrd and Florida Attorney General Ashley Moody not to enforce the law.
“Here, the record is clear that individuals like Ms. Herrera-Lucha and Ms. Martínez either can no longer work as paid canvassers or have had the terms of their employment substantially changed for fear of running afoul of the citizenship requirement,” Walker wrote in his ruling.
“Here plaintiffs have suffered — and continue to suffer — irreparable injuries. Indeed, the individual members in this case have been unconstitutionally discriminated against based on their non-citizenship status,” Walker added.
The groups that won the rule said they are prepared to begin ramping up voter registration efforts in Florida.
“Denying noncitizens the ability to help register eligible voters in their communities is unconstitutional and discriminatory,” LatinoJustice PRLDEF attorney Miranda Galindo said.
League of Women Voters of Florida co-president Cecile M. Scoon celebrated the ruling for allowing non-American citizens to participate in democracy.
DeSantis ally slams Obama judge’s ruling against election integrity
State Senator Blaise Ingoglia (R-FL), a top ally of DeSantis in the Florida Legislature, slammed Walker’s decision in the case.
“The groups that file these lawsuits attempting to stop common-sense election reforms are nothing but partisan actors masquerading as nonpartisan nonprofits,” Ingoglia told The Floridian.
He pointed out that Walker ruled against other signature bills signed by DeSantis including sections of the Stop WOKE Act and a 2021 bill designed to crack down on rioting.
“This ruling is yet another in a long line of poor election law rulings by activist Judge Mark Walker that will be eventually overturned on appeal. He has a horrible track record of consistently getting it wrong,” Ingoglia added.
Democrats are willing to use any means necessary to get an edge in elections.
